{"id":11128,"date":"2022-02-07T15:48:25","date_gmt":"2022-02-07T15:48:25","guid":{"rendered":"https:\/\/www.withinnigeria.com\/broadnews\/?p=11128"},"modified":"2022-02-07T15:48:25","modified_gmt":"2022-02-07T15:48:25","slug":"odili-passport-seizure-court-vacates-orders-against-nis-lawyer","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/broadnews\/2022\/02\/07\/odili-passport-seizure-court-vacates-orders-against-nis-lawyer\/","title":{"rendered":"Odili passport seizure: Court vacates orders against NIS lawyer"},"content":{"rendered":"<div id=\"yMail_cursorElementTracker_1644227547497\">A Federal High Court, Abuja, on Monday, vacated the order made against the Nigeria Immigration Service (NIS) lawyer, Jimoh Adamu, over his alleged refusal to appear before it<\/div>\n<div id=\"yMail_cursorElementTracker_1644228904016\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644228917051\">Justice Inyang Ekwo also vacated the Dec. 21, 2021 order directing the NIS to pay N2 million fine for alleged failure to release the international passport of former Governor of Rivers, Peter Odili, days after the prayer was granted.<\/div>\n<div id=\"yMail_cursorElementTracker_1644229139562\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644229139734\">The development followed Odili\u2019s confirmation in the courtroom that the NIS had complied with the order on Dec. 20, 2021.<\/div>\n<div id=\"yMail_cursorElementTracker_1644229525453\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644229525572\">Ifedayo Adedipe, SAN, who appeared for the former governor, told the court shortly after Adamu cleared the air on the controversy.<\/div>\n<div id=\"yMail_cursorElementTracker_1644229638552\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644229638700\">\n<div id=\"yMail_cursorElementTracker_1644229709029\">The News Agency of Nigeria (NAN) reports that Justice Ekwo had, on Dec. 21, 2021, summoned Adamu over his failure to appear before the court on two occasions and the refusal of his office to release the travel documents of former <a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2021\/12\/13\/pdp-governors-celebrate-rivers-state-gov-wike-at-58\/\">Rivers Governor, Peter Odili<\/a> after a court order.<\/div>\n<div id=\"yiv0673670955yMail_cursorElementTracker_1644224357396\"><\/div>\n<div id=\"yiv0673670955yMail_cursorElementTracker_1644224357396\">The judge, who ordered the NIS to pay a N2 million fine for its conduct, directed the Attorney-General of the Federation (AGF) to take disciplinary action against lawyer to NIS for alleged unprofessional conduct.<\/div>\n<div id=\"yiv0673670955yMail_cursorElementTracker_1644224357396\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644229736667\">The court also struck out the motion for stay of execution filed by the NIS against its order and ordered Adamu to appear before it on Jan. 21 to show cause why a disciplinary action should not be taken against him.<\/div>\n<div id=\"yMail_cursorElementTracker_1644230016866\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644230017000\">But on that day, Adamu was again not in court.<\/div>\n<div id=\"yMail_cursorElementTracker_1644229738709\">\n<div id=\"yMail_cursorElementTracker_1644231285141\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644231287535\">An NIS lawyer, Bichi Abba, who announced appearance in the matter, said Adamu was indisposed, and the judge fixed today (Feb. 7) for Adamu to appear for the last chance.<\/div>\n<div id=\"yMail_cursorElementTracker_1644231413419\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644231678161\">There was, however, controversy on Monday when Adamu appeared in court, stating that his office (NIS) had complied with the order since Dec. 20, 2021.<\/div>\n<div id=\"yMail_cursorElementTracker_1644231768692\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644231795952\">He expressed surprise over Adedipe\u2019s misinformation, which he said had cost him so much embarrassment.<\/div>\n<div id=\"yMail_cursorElementTracker_1644232283727\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644232283870\">He stressed that the NIS had since complied though he had been unable to file an affidavit to the effect.<\/div>\n<div id=\"yMail_cursorElementTracker_1644231875054\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644231875163\">\u201cMy lord, I sincerely apologise that I didn\u2019t file affidavit to show course for compliance. I am under the weather,\u201d he said.<\/div>\n<\/div>\n<\/div>\n<div id=\"yiv0673670955yMail_cursorElementTracker_1644223209150\"><\/div>\n<div id=\"yiv0673670955yMail_cursorElementTracker_1644223209333\">Responding, Adedipe said he was informed over the weekend that his client\u2019s passport had been released to him in accordance with the court order.<\/div>\n<div id=\"yMail_cursorElementTracker_1644232494268\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644232507461\">He urged the court to put a stop to the hearing already slated for Adamu to appear to show cause why a disciplinary action should not be meted out to him.<\/div>\n<div id=\"yMail_cursorElementTracker_1644232613430\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644233468883\">Adamu, who was visibly angry over the development, said he did not disrespect the court contrary to the insinuation.<\/div>\n<div id=\"yMail_cursorElementTracker_1644233547869\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644233553938\">He said since the order of the court, he had been reporting at the Office of the Attorney-General of the Federation on a daily basis until it was clarified that he was not at fault.<\/div>\n<div id=\"yMail_cursorElementTracker_1644233704920\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644233705043\">\u201cMy lord, my name has been on social media for an offence I did not commit,\u201d he said.<\/div>\n<div id=\"yMail_cursorElementTracker_1644235299214\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644235299377\">\n<div id=\"yMail_cursorElementTracker_1644235303517\">Adamu then prayed the court to discharge all the orders made against him and his office, including the order to pay the sum of N2 million for failure to release the travel documents.<\/div>\n<\/div>\n<div id=\"yMail_cursorElementTracker_1644233756607\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644233756793\">In the affidavit of compliance and to show cause dated Feb. 7 and filed same date, Adamu said upon receipt of court judgment and Odili\u2019s letter requesting release of his passport dated Dec. 17, 2021, NIS complied on Dec. 20, 2021.<\/div>\n<div id=\"yMail_cursorElementTracker_1644234003486\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644234003674\">He said the Passport Numbers: A5021427 and B50031305 were released to Justice Njideka Nwosu-Iheme, Odili\u2019s daughter, who is also a judge at a Federal Capital Territory (FCT) Court, in accordance with Odili\u2019s instruction in the letter signed by him.<\/div>\n<div id=\"yMail_cursorElementTracker_1644234355717\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644234355819\">The lawyer averred that not only did the passports handed over to Odili, he said the ex-governor\u2019s name was removed from the watchlist on same day in compliance with court order.<\/div>\n<div id=\"yMail_cursorElementTracker_1644234556500\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644234556597\">He said since Odili\u2019s counsel misled the court in giving an order for disciplinary action against him, it had caused unnecessary hardship on him emotionally, psychologically, physically and otherwise.<\/div>\n<div id=\"yMail_cursorElementTracker_1644234721906\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644234722014\">He stressed that it had also put his reputation to disrepute and exposed him to public odium and redicule.<\/div>\n<div id=\"yMail_cursorElementTracker_1644234792595\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644234810014\">He said it was Adedipe who misled the court that deserved to be sanctioned and face the disciplinary action of the court.<\/div>\n<div id=\"yMail_cursorElementTracker_1644234873225\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644234873342\">Beside, Adamu averred that Adedipe did not also inform the court that the appeal in the case was entered on Jan. 20 after service had been effected on him making the Court of Appeal seized of the matter.<\/div>\n<div id=\"yMail_cursorElementTracker_1644235023716\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644235023846\">He said the senior lawyer\u2019s action in the court\u2019s proceedings on Dec. 21, 2021 and Jan. 21 deserved to be reported to the Legal Practitioner Disciplinary Committee for misconduct and appropriate taken.<\/div>\n<div id=\"yMail_cursorElementTracker_1644235171131\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644235444890\">Justice Ekwo, after perusing the affidavit and other exhibits attached, vacated the orders against Adamu and NIS.<\/div>\n<div id=\"yMail_cursorElementTracker_1644235490423\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644235490572\">The judge adjourned the matter until April 25 for report on the Court of Appeal\u2019s decision.<\/div>\n<div id=\"yMail_cursorElementTracker_1644235581599\"><\/div>\n<div id=\"yiv0673670955yMail_cursorElementTracker_1644224357396\">\n<div id=\"yMail_cursorElementTracker_1644235641665\">NAN reports that Justice Ekwo had, on Oct. 18, 2021, in a suit filed by Odili against the NIS and its Comptroller General, ordered the immediate release and return of his International passports.<\/div>\n<div id=\"yMail_cursorElementTracker_1644235661207\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644235667849\">Ekwo had also ordered the NIS to write an apology to Odili for the unlawful seizure of his passport as well as the embarrassment meted to him.<\/div>\n<div id=\"yMail_cursorElementTracker_1644235668755\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644235677536\">However, about 37 days after the court judgment, the NIS on Nov. 23, 2021, told the court to stay execution because it had appealed the judgment.<\/div>\n<div id=\"yMail_cursorElementTracker_1644235678595\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644235676827\">In a motion filed before the court, the NIS had sought a stay of execution on the judgement it delivered.<\/div>\n<div id=\"yMail_cursorElementTracker_1644235683280\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644235685840\">Ekwo, who then adjourned on the condition that the NIS must submit Odili\u2019s passport with the court registrar as a condition for their motion to be heard, fixed a date for hearing the application.<\/div>\n<div id=\"yMail_cursorElementTracker_1644235699492\"><\/div>\n<div id=\"yMail_cursorElementTracker_1644235698121\">But on the adjourned date, no counsel appeared for the NIS, and counsel to Odili, Adedipe, made an application against the NIS, urging the court to
