{"id":17905,"date":"2022-04-11T16:11:40","date_gmt":"2022-04-11T16:11:40","guid":{"rendered":"https:\/\/www.withinnigeria.com\/broadnews\/?p=17905"},"modified":"2022-04-11T16:14:48","modified_gmt":"2022-04-11T16:14:48","slug":"defection-court-vacation-stalls-judgment-in-suit-seeking-dogaras-sack","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/11\/defection-court-vacation-stalls-judgment-in-suit-seeking-dogaras-sack\/","title":{"rendered":"Defection: Court vacation stalls judgment in suit seeking Dogara\u2019s sack"},"content":{"rendered":"<p><span style=\"font-weight: 400\">The Federal High Court (FHC)\u2019s vacation has stalled the judgment in a suit seeking the declaration of the seat of Rep Yakubu Dogara vacant on account of his defection to the<\/span><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/10\/lg-poll-pdp-sweeps-all-21-lgs-in-adamawa\/\"><span style=\"font-weight: 400\"> All Progressives Congress (APC)<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Our reporter had, on March 23, reported that the judgment, in two separate suits filed against Dogara, was fixed for today, Monday, by Justice Donatus Okorowo of an<\/span><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/09\/national-para-sports-festival-45-athletes-representing-kwara-depart-for-abuja\/\"><span style=\"font-weight: 400\"> Abuja<\/span><\/a><span style=\"font-weight: 400\"> division of FHC.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The first suit was marked: FHC\/ABJ\/CS\/883\/30 and filed by Incorporated Trustees of United Global Resources for Peace<\/span><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2021\/12\/10\/ecowas-protocol-organisation-advocates-better-governance\/\"><span style=\"font-weight: 400\"> Organisation<\/span><\/a><span style=\"font-weight: 400\"> Vs. Rep Yakubu Dogara and five others were number one on the cause list.<\/span><\/p>\n<p><span style=\"font-weight: 400\">However, the second suit marked: FHC\/ABJ\/CS\/1060\/20 filed by the Peoples Democratic Party<\/span><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/11\/2023-elections-pdp-debunk-denying-sen-utazi-right-to-purchase-senate-nomination-form\/\"><span style=\"font-weight: 400\"> (PDP)<\/span><\/a><span style=\"font-weight: 400\"> Vs. Rep Yakubu Dogara and four others, were on number five in today\u2019s cause list.<\/span><\/p>\n<p><span style=\"font-weight: 400\">When our correspondent visited Court 6 where<\/span><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/11\/apply-moral-legal-procedures-in-justice-dispensation-cj-tells-lawyers-judges\/\"><span style=\"font-weight: 400\"> Justice<\/span><\/a><span style=\"font-weight: 400\"> Okorowo presides, the courtroom was empty with the court registrar and other workers doing their daily activities.<\/span><\/p>\n<p><span style=\"font-weight: 400\">However, the judgments could not be delivered since FHC had begun its<\/span><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/10\/palm-sunday-kwara-deputy-gov-joins-rally-in-llorin\/\"><span style=\"font-weight: 400\"> Easter<\/span><\/a><span style=\"font-weight: 400\"> Vacation.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The court began the vacation on April 8 and will end on April 25.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cMy lord is waiting for the Chief Judge of the court will give a fiat for the judgments to be delivered during this vacation. But as it is now, no date has been fixed and parties will be communicated as soon as another date is fixed,\u201d one of the<\/span><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/11\/court-remands-trader-over-alleged-kidnap-of-neighbours-son\/\"><span style=\"font-weight: 400\"> court<\/span><\/a><span style=\"font-weight: 400\"> workers told our correspondent&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400\">Reports have it that the PDP and the group had asked the court to remove the former Speaker, House of Representatives, Dogara, as a member representing Dass, Tafawa Balewa, and Bogoro Federal Constituency of Bauchi State, over his defection to<\/span><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/09\/apc-primaries-im-not-afraid-of-tinubu-other-gladiators-yahaya-bello\/\"><span style=\"font-weight: 400\"> APC<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">While the PDP is the plaintiff, Dogara, the speaker of the House of Representatives, the Attorney General of the Federation (AGF), the Independent National Electoral Commission<\/span><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/09\/2023-nrm-pledges-better-deal-for-nigerians\/\"><span style=\"font-weight: 400\"> (INEC)<\/span><\/a><span style=\"font-weight: 400\">, and the APC are 1st to 4th defendants respectively in the second suit.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Dogara had, on July 24, 2020, defected from the PDP to the APC when he submitted a resignation letter to the chairman of the Bogoro \u2018C\u2019 Ward in the state.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The plaintiff, through their counsel, Jubrin Jubrin, said by virtue of Section 68(1)(g) of the Constitution, Dogara by defecting from the party that sponsored him to the ninth National Assembly before the expiration of his tenure, ought to vacate the seat as he was no longer qualified to partake in the activities of the lower<\/span><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/03\/11\/insecurity-army-calls-on-media-houses-to-report-its-positive-activities\/\"><span style=\"font-weight: 400\"> house<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Reports have it that Justice Inyang Ekwo, a sister judge, had, on March 8, sacked Governor David Umahi of Ebonyi and his deputy, Kelechi Igwe, alongside other lawmakers who dumped the PDP for APC, describing their action as unlawful.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Justice Taiwo Taiwo, another judge in the Abuja division, had also, on March 21,, ordered the 20 lawmakers from Cross River to vacate their seats following their defection from the PDP to APC.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The lawmakers comprise two House of Representatives members and 18 state House of Assembly members.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Federal High Court (FHC)\u2019s vacation has stalled the judgment in a suit seeking the declaration of the seat of Rep Yakubu Dogara vacant on account of his defection to the All Progressives Congress (APC).
