{"id":22023,"date":"2022-04-29T17:37:29","date_gmt":"2022-04-29T17:37:29","guid":{"rendered":"https:\/\/www.withinnigeria.com\/broadnews\/?p=22023"},"modified":"2022-04-29T17:37:29","modified_gmt":"2022-04-29T17:37:29","slug":"holding-charge-largely-responsible-for-prison-congestion-ngo","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/29\/holding-charge-largely-responsible-for-prison-congestion-ngo\/","title":{"rendered":"Holding charge largely responsible for prison congestion \u2013 NGO"},"content":{"rendered":"<header class=\"entry-header\" aria-label=\"Content\">\n<h1 class=\"entry-title\"><span style=\"font-size: 16px\">The Country Director of the Advocacy for Justice and Accountability, Mr Ogedi Ogu, has called for the elimination of the practice of \u201cholding charges\u201d to avoid congestion in the nation\u2019s correctional centres.<\/span><\/h1>\n<\/header>\n<div class=\"entry-content\">\n<p>A holding charge is a temporary charge against <a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/27\/human-trafficking-police-arrest-4-suspects-in-adamawa\/\">suspects<\/a> aimed at keeping them in custody.<\/p>\n<p>Ogu disclosed this in an interview our correspondent on Friday in Lagos.<\/p>\n<p>He said that situations whereby suspects were arraigned before magistrate courts on a holding charge should be dispensed to discourage congestion.<\/p>\n<p>\u201cIt is important we treat our justice system with caution; situations where suspects are arraigned before a magistrate court which does not have jurisdiction over such cases, should be thrashed.<\/p>\n<p>\u201cThe law is trite on the issue of holding charges, but eventhough we know that our laws have abolished same, it is in practice.<\/p>\n<p>\u201cYou find that rather than arraign suspects before a high court with jurisdiction over an offence, they are brought before a magistrate <a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/29\/court-remands-security-guard-for-allegedly-defiling-7-year-old-girl\/\">court<\/a>.<\/p>\n<p>\u201cThe problem with this practice is that these suspects are remanded in our correctional facilities, while awaiting legal advice from the Directorate of Public Prosecution (DPP).<\/p>\n<p>\u201cSo, the question is why not take these suspects before a high court with the requisite jurisdiction so that the court can decide whether or not to grant bail,\u201d Ogu said<\/p>\n<p>According to him, some of these DPP advice often take a length of time to emerge, adding that while the delay lingers, the correctional centres are continually over crowded.<\/p>\n<p>\u201cSecondly, the law on DPP advice must be obeyed; infact, if after 30 days the DPP is not forth coming with the legal advice, then it is of no use keeping the suspects in custody,\u201d he added.<\/p>\n<p>Ogu noted that while a delayed legal advice occasions prison congestion, the law mandates the Attorney-General to make such advice available after 30 days.<\/p>\n<p>\u201cThe law provides that after 30 days the office of the Attorney-General must provide the legal advice.<\/p>\n<p>\u201cBut you find that in the correctional centres, there are inmates awaiting legal advice for as long as eight years, and you wonder what has happened to the law which mandates a production of such advice within 30 days,\u201d he said<\/p>\n<p>Ogu, however, urged that the provisions on legal advice be adhered to in the interest of justice.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The Country Director of the Advocacy for Justice and Accountability, Mr Ogedi Ogu, has called for the elimination of the practice of \u201cholding charges\u201d to avoid congestion in the nation\u2019s correctional centres.
