{"id":30838,"date":"2022-06-20T12:33:45","date_gmt":"2022-06-20T12:33:45","guid":{"rendered":"https:\/\/www.withinnigeria.com\/broadnews\/?p=30838"},"modified":"2022-06-20T12:33:45","modified_gmt":"2022-06-20T12:33:45","slug":"court-steps-down-osinachi-husbands-case-due-to-multiple-counsel","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/broadnews\/2022\/06\/20\/court-steps-down-osinachi-husbands-case-due-to-multiple-counsel\/","title":{"rendered":"Court steps down Osinachi husband\u2019s case due to multiple counsel"},"content":{"rendered":"<p>The alleged culpable homicide suit against Peter Nwachukwu, husband of the late gospel singer, Osinachi in a Federal Capital Territory High Court on Monday, was stepped down in order for his lawyers to align themselves to represent him.<\/p>\n<p>When the matter slated for hearing before <a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/02\/07\/odili-passport-seizure-court-vacates-orders-against-nis-lawyer\/\">Justice Njideka Nwosu-Iheme<\/a> came up, the Prosecution Counsel, Aderonke Imana, informed the court that the matter was for hearing and that they were ready to proceed.<\/p>\n<p>A. Ogbonna also announced his appearance as watching brief of the nominal complainant.<\/p>\n<p>The counsel that represented the defendant during his arraignment, Victor Abakpa, however prayed the court to adjourn the matter until Tuesday, as another lawyer from a different chamber just informed that he was taking over the case.<\/p>\n<p>He further stated that he was equally served additional proof of evidence in the court just before the court started the day\u2019s proceedings.<\/p>\n<p>I.A Aliyu on his part informed the court that he was briefed by the defendant on June 18 to take over the case.<\/p>\n<p>The court therefore stepped down the case to 11am in order for counsel to align themselves and come proper before it.<\/p>\n<p>Reports have it that in Monday\u2019s proceeding, family members of the deceased singer, Osinachi were in court.<\/p>\n<p>Prominent amongst the family members were her two children, mother and twin sister.<\/p>\n<p>The matter which was adjourned until June 16, could not go on due to the absence of the judge.<\/p>\n<p>The defendant was earlier arraigned on June 3, and was remanded in<a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/05\/26\/abba-kyari-prays-court-for-bail-over-alleged-threat-to-life-in-kuje-prison\/\"> Kuje Correctional Centre<\/a> after he pleaded not guilty to the alleged homicide charge filed against him by the Attorney -General of the Federation.<\/p>\n<p>He was therefore remanded pending the hearing and determination of the<br \/>\n23-count charge bordering on domestic violence and homicide instituted against him.<\/p>\n<p>Nwachukwu was arrested by the Nigeria Police after his wife died on April 8 following wide spread allegations by their children, family and colleagues that he battered her leading to her death.<\/p>\n<p>According to the charge, the crime he allegedly committed contravenes Sections 104 and 379 of the Administration of Criminal Justice Act, (ACJA) 2015, Section 221 of the Penal Code and the Violence Against Person\u2019s Prohibition Act (VAPP) 2015.<\/p>\n<p>The charge read in part: \u201cThat you Peter Nwachukwu, 56, male, on the April 8 at Aco Estate, opposite Police Station, Lugbe, Abuja, FCT, within the jurisdiction of this court, did commit an offence to with: culpable homicide punishable with death in that you caused the death of Osinachi N.<\/p>\n<p>\u201cThis was caused by your various acts of violence and aggravated assault with the knowledge that her death would be the probable consequence of your act.<\/p>\n<p>\u201cParticulars of offence: That you, Peter Nwachukwu, male, sometime between Nov. 14, 2009 and April 2022 at Aco Estate, opposite Police Station, Lugbe, Abuja, FCT, within the jurisdiction of this court, did commit an offence to wit: emotional, verbal and psychological abuse on <a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/14\/foundation-describes-osinachis-death-as-wake-up-call-to-end-domestic-violence\/\">Mrs Osinachi Nwachukwu<\/a> (deceased).<\/p>\n<p>\u201cThis was caused by humiliating her and making utterances like \u2018you are smelling,\u2019 \u2018you are mad,\u2019 to her in the presence of her music crew members.\u201d<\/p>\n<p>The statement of offence bordered on emotional, verbal and psychological abuse contrary to Section 14(1) of the Violence Against Persons (Prohibition) Act, 2015 and punishable under the same section of the Act.<\/p>\n<p>The late gospel singer was popularly known for her song \u201cEkwueme\u201d.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The alleged culpable homicide suit against Peter Nwachukwu, husband of the late gospel singer, Osinachi in a Federal Capital Territory High Court on Monday, was stepped down in order for his lawyers to align themselves to represent him.
