{"id":32352,"date":"2022-06-29T15:31:38","date_gmt":"2022-06-29T15:31:38","guid":{"rendered":"https:\/\/www.withinnigeria.com\/broadnews\/?p=32352"},"modified":"2022-06-29T15:31:38","modified_gmt":"2022-06-29T15:31:38","slug":"alleged-armed-robbery-absence-of-police-counsel-stalls-trial-of-man","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/broadnews\/2022\/06\/29\/alleged-armed-robbery-absence-of-police-counsel-stalls-trial-of-man\/","title":{"rendered":"Alleged armed robbery: Absence of police counsel stalls trial of man\u00a0"},"content":{"rendered":"<header class=\"entry-header\" aria-label=\"Content\"><\/header>\n<div class=\"entry-content\">\n<div dir=\"auto\">The absence of a Prosecution Counsel, Hope Bob-manuel, in a Federal Capital Territory (FCT) High Court, Kubwa on Wednesday, stalled the trial of Usman Mahmud charged with <a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/06\/24\/police-arraign-man-for-alleged-armed-robbery-in-benue\/\">armed robbery<\/a>.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Mahmud pleaded not guilty to the charge.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">At the resumed trial, the Defence Counsel, Uzoma Aneto told the court that the prosecution counsel was also absent on June 20.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\u201cBefore the last date, I filed a motion on notice, seeking for the defendant to be discharged or alternatively granted bail on liberal terms which I served the prosecution counsel, \u201d Aneto said.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">She cited Section 351 of the Administration of Criminal Justice Act (ACJA) which states that the court has the power to do justice when the prosecution has been served and shows no reason for his absence.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">She however urged the court to exercise its discretion in her favour.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Justice Asmau Akanbi-Yusuf however adjourned the matter until July 6 for a ruling.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The News Agency of Nigeria (NAN) reports that the police alleged that the defendant and others at large robbed one Yahaya Abdulmutallab of FCDA Estate, Wuse 2, Abuja on Nov.29, 2020.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The prosecution counsel alleged that the defendant robbed Abdulmutallab at <a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/06\/22\/tricycle-operator-rapes-robs-passenger-at-gunpoint-in-ogun\/\">gunpoint<\/a> of his phones, cash and property worth N1. 2million.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The offence, she said, is punishable under Section 1(2)(b) of the Robbery and Firearms Act of 2004.<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The absence of a Prosecution Counsel, Hope Bob-manuel, in a Federal Capital Territory (FCT) High Court, Kubwa on Wednesday, stalled the trial of Usman Mahmud charged with armed robbery.
