{"id":32555,"date":"2022-06-30T17:27:23","date_gmt":"2022-06-30T17:27:23","guid":{"rendered":"https:\/\/www.withinnigeria.com\/broadnews\/?p=32555"},"modified":"2022-06-30T17:27:23","modified_gmt":"2022-06-30T17:27:23","slug":"migrants-cannot-be-detained-solely-for-staying-illegally-eu-top-court","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/broadnews\/2022\/06\/30\/migrants-cannot-be-detained-solely-for-staying-illegally-eu-top-court\/","title":{"rendered":"Migrants cannot be detained solely for staying illegally &#8211; EU top court"},"content":{"rendered":"<header class=\"entry-header\" aria-label=\"Content\"><\/header>\n<div class=\"entry-content\">\n<p>The European Court of Justice (ECJ) on Thursday said that <a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/06\/28\/morocco-prosecutes-65-migrants-involved-in-deadly-melilla-incident\/\">migrants<\/a> cannot be detained solely for staying illegally.<\/p>\n<p>The ruling by the top court is linked to events last summer in Lithuania when several thousand people tried to cross into the <a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/05\/06\/eu-to-mark-european-day-after-3-years-of-virtual-celebration\/\">European Union<\/a> via Belarus.<\/p>\n<p>The ECJ found that unless the EU country proves that the third-country national poses a threat to the national security, migrants cannot be detained for their lack of papers, and the right to request asylum has to be granted even in emergency situations.<\/p>\n<p>Lithuanian courts referred to the ECJ for clarification on the case of a non-EU citizen who was detained by Lithuanian authorities upon arrival and subsequently tried to apply for international protection.<\/p>\n<p>The request, however, was rejected as Lithuanian law denies people arriving during a mass migration event the possibility to claim asylum.<\/p>\n<p>The plaintiff\u2019s detention was hence prolonged on the grounds of having entered the country without the necessary permits, against which the person appealed.<\/p>\n<p>PRO ASYL, a German pro-immigration advocacy organisation, welcomed the ruling saying, in a press release, it shows that \u201cpushbacks are illegal,\u2019\u2019 referring to a practice of forcing migrants out of the country without the possibility to apply for asylum.<\/p>\n<p>Several human rights organisations have accused the Lithuanian authorities of having carried out pushbacks.<\/p>\n<p>\u201cThe court has shown EU states some red lines,\u2019\u2019 said Karl Kopp, head of PRO ASYL\u2019s European department, in the statement.<\/p>\n<p>The Lithuanian courts can now rule on the pending case taking the ECJ\u2019s judgment into account, which can also serve as a guideline for other national courts facing similar cases.<\/p>\n<p>In a separate development, the Lithuanian government announced that it is to receive \u20ac55 million ($57 million) from the European Commission in financial aid to equip its entire border with Belarus with surveillance systems, the Interior Ministry in Vilnius announced on Thursday.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The European Court of Justice (ECJ) on Thursday said that migrants cannot be detained solely for staying illegally.
