{"id":34794,"date":"2022-07-15T07:55:09","date_gmt":"2022-07-15T07:55:09","guid":{"rendered":"https:\/\/www.withinnigeria.com\/broadnews\/?p=34794"},"modified":"2022-07-15T07:55:09","modified_gmt":"2022-07-15T07:55:09","slug":"baba-ijesha-should-be-thankful-for-minimal-sentencing-ex-nba-vice-chair-lawyer","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/broadnews\/2022\/07\/15\/baba-ijesha-should-be-thankful-for-minimal-sentencing-ex-nba-vice-chair-lawyer\/","title":{"rendered":"Baba Ijesha should be thankful for minimal sentencing \u2013 ex-NBA vice chair, lawyer"},"content":{"rendered":"<p>The Former National Vice Chairman of the <a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2021\/12\/28\/football-association-for-nomadic-children-to-be-established-in-jigawa\/\"><strong>Nigeria Bar Association (NBA)<\/strong><\/a>, Mr Monday Ubani has said the convicted Nollywood actor, <a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/04\/02\/alleged-defilement-baba-ijesha-closes-defence\/\"><strong>Olanrewaju James, alias Baba Ijesha<\/strong><\/a>, who sexually assaulted a 14-year-old minor, should \u00a0be grateful for the \u201cminimal\u201d sentence.<\/p>\n<p>Ubani made this known in an interview with the News Agency of Nigeria on Thursday.<\/p>\n<p>\u201dIf court held that he committed the offence, then he must be very thankful \u00a0to the court for giving him a five-year-sentence because I know sexual assault carries \u00a020 years imprisonment.<\/p>\n<p>\u201cIf the court found out from the evidence that was produced that he actually assaulted that girl, then he must count himself very lucky,\u201d he said.<\/p>\n<p>Ubani, however, said that the convict had right to appeal the sentence to prove his innocence.<\/p>\n<p>\u201cThe convict can go on appeal and from Court of Appeal, he may even proceed to the Supreme Court to prove that he did not commit the offence.<\/p>\n<p>\u201cWe must put into consideration that High Court is not the final court. He still has the right to Court of Appeal and Supreme Court if he wants to,\u201d Ubani said.<\/p>\n<p>Also speaking, a Lagos based-lawyer, Mr Ige Asemudara lauded the decision of the court in sentencing the convict, adding that the court had the final say.<\/p>\n<p>\u201cI was not in the case and did not have the opportunity of seeing the evidence but whatever my Lord said, my Lord has the privilege of seeing the case and hearing from both sides.<\/p>\n<p>\u201cAs such, whatever judgment \u00a0she has given, has come from the evidence before her.<\/p>\n<p>\u201cFor us lawyers, once a judgment \u00a0is given, it becomes law.<\/p>\n<p>\u201cFor the person in which the judgment is given, it becomes a legal liability \u00a0and for the person \u00a0whose favour it is given, it is a legal right.<\/p>\n<p>\u201cThe convict has a \u00a0duty to serve his term except \u00a0his lawyer wants to file an appeal and he wins in appeal. But at the moment, he is a convict,\u201d Asemudara said.<\/p>\n<p>The convicted actor was on Thursday sentenced to five years imprisonment for sexually \u00a0a 14-year-old minor.<\/p>\n<p>Justice Oluwatoyin Taiwo, in her two hours judgment, held that the prosecution had successfully proven the charge of sexual assault of a minor and indecent treatment of a minor against the convict.<\/p>\n<p>Justice Taiwo said the sentencing, takes effect from July 14.<\/p>\n<p>\u201cThe defendant took his acting too far. Children are frequently preyed on because of their inability to defend themselves.<\/p>\n<p>\u201cHowever, the court is not distracted. The defendant abused the position of friendship.<\/p>\n<p>\u201cThis case brings to the limelight various sexual assault cases in the society despite the efforts \u00a0of government and non-governmental organisations to sensitise the public on incessant cases of sexual assault.<\/p>\n<p>\u201cThe is very sad.
