{"id":35334,"date":"2022-07-19T08:36:04","date_gmt":"2022-07-19T08:36:04","guid":{"rendered":"https:\/\/www.withinnigeria.com\/broadnews\/?p=35334"},"modified":"2022-07-19T08:51:39","modified_gmt":"2022-07-19T08:51:39","slug":"un-expert-urges-kenya-to-implement-court-ruling-on-indigenous-people","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/broadnews\/2022\/07\/19\/un-expert-urges-kenya-to-implement-court-ruling-on-indigenous-people\/","title":{"rendered":"Implement court ruling on indigenous people &#8211; UN expert urges Kenya"},"content":{"rendered":"<p>UN human rights expert, Francisco Tzay, on Monday urged the <a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/07\/13\/kenya-unicef-deploy-therapeutic-food-to-avert-childhood-malnutrition\/\"><strong>Government of Kenya<\/strong><\/a> to respect the Court\u2019s decision and proceed to implement the judgement and the 2017 ruling by the court in favour of indigenous peoples.<\/p>\n<p>Tzay, who is the UN Special Rapporteur on the rights of indigenous peoples in a statement hailed a decision by the African Court on Human and People\u2019s Rights, to award reparations to the Ogiek indigenous peoples, for harm that they suffered due to \u201cinjustices and discrimination.\u201d<\/p>\n<p>\u201cThe historic ruling follows a landmark judgement delivered by the Court on May 26, 2017, finding that the Government of Kenya had violated the right to life, property, natural resources, development, religion and culture of the Ogiek, under the African Charter on Human and Peoples\u2019 Rights.<\/p>\n<p>\u201cThis judgment and award of reparations marks another important step in the struggle of the Ogiek for recognition and protection of their rights to ancestral land in the Mau Forest, and implementation of the 2017 judgment of the African Court,\u201d he said.<\/p>\n<p>The Court ordered the Government of Kenya to pay compensation of 57,850,000 Kenya Shillings (approximately $488,000), for material prejudice for loss of property and natural resources.<\/p>\n<p>Also, the Court ordered Kenya to pay 100,000,000 Shillings for moral prejudice suffered by Ogiek people, due to violations of the right to non-discrimination, religion, culture and development.\u2019\u2019<\/p>\n<p>In addition, the Court ordered non-monetary reparations, including the restitution of Ogiek ancestral lands and full recognition of the Ogiek as indigenous peoples.<\/p>\n<p>The Court also requires the Kenyan Government to undertake delimitation, demarcation, and titling, to protect Ogiek rights to property revolving around occupation, use and enjoyment of the Mau Forest and its resources.<\/p>\n<p>Furthermore, the court ordered Kenya to take necessary legislative, administrative or other measures to recognise, respect and protect the right of the Ogiek to be consulted with regard to development, conservation or investment projects in their ancestral lands.<\/p>\n<p>They must be granted the right to give or withhold their free and informed consent to these projects to ensure minimal damage to their survival, the ruling said.<\/p>\n<p>The independent UN rights expert, Tzay, provided expert testimony to the Court in the landmark case, based on the mandate\u2019s long-standing engagement in the promotion and protection of the rights of the Ogiek.<\/p>\n<p>\u201cI welcome this unprecedented ruling for reparations and acknowledge that the decision sends a strong signal for the protection of the land and cultural rights of the Ogiek in Kenya, and for indigenous peoples\u2019 rights in Africa and around the world,\u201d he said.<\/p>\n<p>Tzay, urged the Government of Kenya to respect the Court\u2019s decision and proceed to implement this judgement and the 2017 ruling by the court without delay.<\/p>\n<p>Special Rapporteurs and independent experts are appointed by the Geneva-based UN Human Rights Council to examine and report back on a specific human rights theme or a country situation.<\/p>\n<p>The positions are honorary and the experts are not paid for their work.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>UN human rights expert, Francisco Tzay, on Monday urged the Government of Kenya to respect the Court\u2019s decision and proceed to implement the judgement and the 2017 ruling by the court in favour of indigenous peoples.
