{"id":44839,"date":"2022-10-20T05:45:21","date_gmt":"2022-10-20T05:45:21","guid":{"rendered":"https:\/\/www.withinnigeria.com\/broadnews\/?p=44839"},"modified":"2022-10-20T05:45:21","modified_gmt":"2022-10-20T05:45:21","slug":"appellate-courts-conflicting-decisions-worrisome-says-olanipekun","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/broadnews\/2022\/10\/20\/appellate-courts-conflicting-decisions-worrisome-says-olanipekun\/","title":{"rendered":"Appellate courts\u2019 conflicting decisions worrisome, says Olanipekun"},"content":{"rendered":"<p>The Chairman, Body of Benchers, <strong><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/05\/06\/2023-elections-progressive-lawyers-oppose-proposed-apc-south-west-presidential-aspirants-meeting\/\">Chief Wole Olanipekun,<\/a> <\/strong>SAN, says lawyers in Nigeria are worried over conflicting decisions being given by the Court of Appeal and Supreme Court.<\/p>\n<p>Olanipekun stated this during a valedictory court session in honour of Justice Mojeed Owoade, who retired as Court of Appeal Justice after attaining the age of 70, on Wednesday in Ibadan.<\/p>\n<p>He said that the issue of conflicting decisions of the <strong><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/08\/23\/lawyers-differ-on-non-execution-of-convicts-sentenced-to-death\/\">appellate courts<\/a><\/strong> had become a very disturbing trend and was distorting the sacred order of judicial precedence.<\/p>\n<blockquote><p>\u201cThere is no gainsaying the fact that nowadays, our appellate courts give conflicting decisions at very regular intervals, thus throwing the profession into confusion.<\/p>\n<p>\u201cMore particularly so, when those conflicting decisions interfere with and derail the agelong doctrine of \u2018stare decisis.\u2019<\/p>\n<p>\u201cI need not to go into specifics in this address but the issues are very notorious.<\/p>\n<p>\u201cAt various fora and special sessions of Supreme Court, senior counsel have taken their turns, have pleaded with the apex court to look into it and arrest this disturbing trend,\u201d<\/p><\/blockquote>\n<p>Olanipekun said.<\/p>\n<p>He called on the <strong><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/10\/19\/history-will-be-fair-to-president-buhari-lai-mohammed\/\">President<\/a><\/strong> and Justices of the Court of Appeal to do everything within their powers and jurisdiction to nip the trend in the bud.<\/p>\n<p>Olanipekun said the conflicting judgements significantly obstructed lawyers\u2019 ability to effectively predict the position of the law in the delivery of legal opinions for clients.<\/p>\n<p>The Senior Advocate described retired Justice Owoade as a leading ambassador of this generation, a shining light for all and a beacon of hope to his peers and others.<\/p>\n<p>In her remark, the President of Court of Apepeal, Justice Monica Dongban-Mensem, described Owoade as an erudite, disciplined and consummate jurists who rose from the academia to the bench.<\/p>\n<p>Represented\u00a0by the Presiding Justice of the <strong><a href=\"https:\/\/www.withinnigeria.com\/broadnews\/2022\/07\/26\/buhari-condoles-with-court-of-appeal-president-over-sons-death\/\">Court of Appeal<\/a><\/strong>, Ibadan, Justice Moor Adumein, the Appeal Court President said that retirement marked the end of an era and the beginning of a new vista.<\/p>\n<p>She said that Owoade deserved to be celebrated for his contributions to the Judiciary and Nigeria in general.<\/p>\n<p>Also speaking, Mr Yakubu Maikyau, SAN, President, Nigerian Bar Association (NBA), said the decisions of Owoade were always in-depth and would continue to resonate in the judiciary.<\/p>\n<p>The event was attended by Gov.
