The Nigeria police has arraigned a student, Shamsudden Bako, and a plumber, Odeh Benjamin,<\/p>\n
for allegedly stealing cell phone worth N37,000 in an Upper Area Court Gwagwalada, FCT.<\/div>\n<\/div>\n
<\/div>\n
Bako and Benjamin were charged with criminal conspiracy, breach of trust and theft.<\/div>\n
<\/div>\n
Mr Abudullahi Tanko, the Prosecution Counsel, told the court that the complainant<\/a>, Ibrahim Maji of old Kutunku reported the matter at the police station On Oct. 16.<\/div>\n
<\/div>\n
According to Tanko, the complainant entrusted his Huawei cellphone worth N37,000 to Bako (first defendant) to hold for him and when he demanded for the phone, the defendant told him that he gave it to Benjamin (second defendant).<\/div>\n
<\/div>\n
Tanko said that Benjamin could not give satisfactory account of the phone when he was questioned.<\/div>\n
<\/div>\n
He added that the offence contravened the provisions of Sections 96, 312 and 287 of the Penal Code.<\/div>\n
<\/div>\n
However, the defendants pleaded not guilty to the charges.<\/div>\n
\n

Mr Isaac Adakole, counsel to the second defendant, prayed the court in an oral bail application to grant his client bail in the most liberal terms.<\/p>\n

He also cited the provisions of sections 158 and 162 of the Administration of Criminal Justice Act (ACJA) to buttress his claims for bail.<\/p>\n

Mr Sani Umar, the presiding Judge, granted the defendants bail in the sum of N20,000 each with one reasonable and reliable surety each in like sum, who must reside within the jurisdiction of the court.<\/p>\n

The Judge also said that two recent passport photographs and valid means of identification must be provided by the sureties.<\/p>\n

Also, he ordered that the address of the sureties must be verified by the court staff and in default the defendant should be remanded in prison custody.<\/p>\n
