{"id":13031,"date":"2021-06-24T12:33:20","date_gmt":"2021-06-24T12:33:20","guid":{"rendered":"https:\/\/www.withinnigeria.com\/entertainment\/?p=13031"},"modified":"2021-06-24T12:33:20","modified_gmt":"2021-06-24T12:33:20","slug":"breaking-baba-ijesha-pleads-not-guilty-to-alleged-child-molestation","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/entertainment\/2021\/06\/24\/breaking-baba-ijesha-pleads-not-guilty-to-alleged-child-molestation\/","title":{"rendered":"BREAKING: Baba Ijesha pleads not guilty to alleged child molestation"},"content":{"rendered":"<p>Embattled Nollywood actor, Olanrewaju Omiyinka, popularly known as Baba Ijesha, on Thursday pleaded not guilty to charges of child molestation before an <a href=\"https:\/\/www.withinnigeria.com\/entertainment\/2021\/06\/24\/baba-ijesha-princess-yomi-fabiyi-arrive-court-over-sexual-assault-case\/\"><strong>Ikeja Special Offences Court in Lagos<\/strong><\/a>.<\/p>\n<p>The actor pleaded not guilty to a six-count charge bordering on indecent treatment of a child, sexual assault, attempted sexual assault by penetration and sexual assault by penetration.<\/p>\n<p>The offences contravene Sections 135, 259, 262, 263 and 262 of the Criminal Law of Lagos State, 2015.<\/p>\n<p>Following the plea, the Lagos State Director of Public Prosecution (DPP), Mrs Olayinka Adeyemi, requested that the defendant should be remanded by the court.<\/p>\n<p>In a bail application supported by a 29-paragraph affidavit, Lead defence counsel, Mr Dada Awosika (SAN), prayed the court to grant the defendant bail in liberal terms.<\/p>\n<p>The bail application was brought pursuant to Section 105(2) and (3) of the Administration of Criminal Justice Law of Lagos State, 2015, and Sections 35 and 36 of the 1999 Constitution of Federal Republic of Nigeria (as amended).<\/p>\n<p>\u201cI will wish to note that the issue of bail, especially on an offence of this nature, is a constitutional right.<\/p>\n<p>\u201cThis is a right the defendant has been deprived of for the past 48 days when he was unlawfully held by the police.<\/p>\n<p>\u201cWe are also not unconscious of the JUSUN strike which made it difficult to bring him to court,\u201d he said.<\/p>\n<p>The counsel prayed the court to grant the defendant bail, saying that it was guaranteed under the 1999 Constitution.<\/p>\n<p>\u201cImagine if this man is kept in detention for many years and is found innocent, will there be any restitution? No.<\/p>\n<p>\u201cJustice and fairness should be done,\u201d he said.<\/p>\n<p>In response, Adeyemi urged that the defendant should be denied bail.<\/p>\n<p>According to her, the defendant is a flight risk and can influence witnesses, if granted bail.<\/p>\n<p>\u201cI want to bring to my lord\u2019s attention the nature of one of the offences \u2013 sexual assault by penetration \u2013 which carries life imprisonment.<\/p>\n<p>\u201c<a href=\"https:\/\/www.withinnigeria.com\/entertainment\/2021\/05\/18\/alleged-rape-yomi-fabiyi-reacts-as-baba-ijesha-is-granted-bail\/\">Bail<\/a> is a discretionary right, it is not a constitutional right.<\/p>\n<p>\u201cOn the nature of the offence and the strength of the evidence, there is a prima facie case before your lordship.<\/p>\n<p>\u201cThe court should take judicial notice of the crime which is rampant in society,\u201d she said.<\/p>\n<p>Adeyemi said that prosecution had six witnesses in the case.<\/p>\n<p>Justice Oluwatoyin Taiwo stood-down proceedings to give ruling on the bail application.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Embattled Nollywood actor, Olanrewaju Omiyinka, popularly known as Baba Ijesha, on Thursday pleaded not guilty to charges of child molestation before an Ikeja Special Offences Court in Lagos.
