{"id":173555,"date":"2024-05-31T09:45:59","date_gmt":"2024-05-31T09:45:59","guid":{"rendered":"https:\/\/www.withinnigeria.com\/entertainment\/?p=173555"},"modified":"2024-05-31T09:45:59","modified_gmt":"2024-05-31T09:45:59","slug":"naira-marleys-cybercrime-trial-stalled","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/entertainment\/2024\/05\/31\/naira-marleys-cybercrime-trial-stalled\/","title":{"rendered":"Naira Marley\u2019s cybercrime trial stalled"},"content":{"rendered":"<ul>\n<li class=\"p1\"><strong>Naira Marley\u2019s cybercrime trial has been stalled.\u00a0<\/strong><\/li>\n<li class=\"p1\"><strong><span class=\"s1\">The criminal trail could not proceed because a fiat by the chief judge of the federal high court is yet to be approved. <\/span><\/strong><\/li>\n<li class=\"p1\"><strong><span class=\"s1\">Recall the Economic and Financial Crimes Commission (EFCC) is prosecuting Naira Marley for alleged cybercrime.<\/span><\/strong><\/li>\n<\/ul>\n<hr \/>\n<p class=\"p1\"><span class=\"s1\">The criminal trial of Nigerian singer, Azeez Fashola a.k.a Naira Marley could not proceed on Thursday, May 30 before a Federal High Court<span class=\"Apple-converted-space\">\u00a0 <\/span>in Lagos.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The trial was stalled because parties in the suit are still awaiting approval of a fiat by the chief judge of the Federal High Court.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The Economic and Financial Crimes Commission is prosecuting Fashola for alleged cyber crime.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The anti-graft agency preferred the charges on May 14, 2019.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><a href=\"https:\/\/www.withinnigeria.com\/entertainment\/2024\/05\/11\/naira-marley-and-sam-larry-dance-to-portables-diss-track-about-them-video\/\">Fashola, who sang the popular song \u201cAm I a Yahoo Boy\u201d,<\/a> was arraigned on May 20, 2019, before Justice Nicholas Oweibo, who pleaded not guilty.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Oweibo granted him bail in the sum of two million Naira with two sureties in like sum.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Witnesses were still being led in evidence by EFCC when Oweibo was transfered out of the Lagos division of the court.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The case was, therefore, transferred to Justice Isaac Dipeolu.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">On March 6, when the case was first mentioned before Dipeolu, both defence and prosecution counsel confirmed to the judge that there was a pending fiat awaiting a response from the chief judge.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The judge consequently adjourned the case until Thursday (May 30) for the report.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">On Thursday, journalists learnt that the fiat had yet to be approved.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">There is no slated date yet for the continuation of the trial.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">According to the EFCC, the defendant committed the offences on different dates between Nov. 26, 2018, and Dec.11, 2018, as well as on May 10, 2019.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The commission alleged that Fashola and his accomplices conspired to use different Access Bank automated teller machine cards to defraud their victims.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">It alleged that the defendant used a bank credit card issued to another person in a bid to obtain fraudulent financial gains.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The EFCC also said that the defendant possessed counterfeit credit cards belonging to different people, with intent to defraud,<span class=\"Apple-converted-space\">\u00a0 <\/span>which, it said, amounted to theft.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The alleged offences contravene Sections 1 23 (1) (b), 27 (1), and 33(9) of the Cyber Crime (Prohibition) Prevention Act, 2015.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">(NAN)<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Naira Marley\u2019s cybercrime trial has been stalled.\u00a0 The criminal trail could not proceed because a fiat by the chief judge of the federal high court is yet to be approved.
