{"id":197279,"date":"2024-11-28T06:12:38","date_gmt":"2024-11-28T06:12:38","guid":{"rendered":"https:\/\/www.withinnigeria.com\/entertainment\/?p=197279"},"modified":"2024-11-28T06:12:38","modified_gmt":"2024-11-28T06:12:38","slug":"sinach-court-adjourns-n5bn-copyright-infringement-lawsuit","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/entertainment\/2024\/11\/28\/sinach-court-adjourns-n5bn-copyright-infringement-lawsuit\/","title":{"rendered":"Sinach: Court adjourns N5bn copyright infringement lawsuit"},"content":{"rendered":"<ul>\n<li class=\"p2\"><strong>Sinach has been slammed a N5 billion lawsuit over alleged copyright infringement of one of her hit songs.<\/strong><\/li>\n<li class=\"p2\"><strong><span class=\"s1\">The Gospel singer\u2019s case was heard by a court on Wednesday, November 27. <\/span><\/strong><\/li>\n<li class=\"p2\"><strong><span class=\"s1\">The court adjourned the case and gave a new date for the hearing.<\/span><\/strong><\/li>\n<\/ul>\n<hr \/>\n<p class=\"p2\"><span class=\"s2\">The federal high court in Lagos has adjourned the \u201ccopyright infringement\u201d suit filed against gospel singer Sinach by music producer Michael Oluwole till January 2025.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Oluwole, also known as Maye, filed a N5 billion lawsuit against Sinach over her 2016 hit song \u2018Way Maker\u2019.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Maye, in suit number FHC\/L\/CS\/402\/2024, seeks a declaration from the court that he is an author and co-owner of the musical work.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">He also demands general damages of N5 billion for alleged cumulative infringements of his rights.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">The plaintiff is seeking, among other reliefs, an order requiring that, in the absence of a written agreement with the defendant, all fees generated from licenses or assignments of copyright in \u2018Way Maker\u2019 be equitably shared between them as co-owners.<\/span><\/p>\n<figure id=\"attachment_197282\" aria-describedby=\"caption-attachment-197282\" style=\"width: 900px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2024\/11\/IMG_6695.jpeg\"><img decoding=\"async\" class=\"size-full wp-image-197282\" src=\"https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2024\/11\/IMG_6695.jpeg\" alt=\"\" width=\"900\" height=\"900\" srcset=\"https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2024\/11\/IMG_6695.jpeg 900w, https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2024\/11\/IMG_6695-300x300.jpeg 300w, https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2024\/11\/IMG_6695-150x150.jpeg 150w, https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2024\/11\/IMG_6695-768x768.jpeg 768w, https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2024\/11\/IMG_6695-75x75.jpeg 75w, https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2024\/11\/IMG_6695-350x350.jpeg 350w\" sizes=\"(max-width: 900px) 100vw, 900px\" \/><\/a><figcaption id=\"caption-attachment-197282\" class=\"wp-caption-text\">Sinach<\/figcaption><\/figure>\n<p class=\"p2\"><span class=\"s1\">\u201c<em>The plaintiff also requests the court to: Determine an equitable division of fees as either an equal share or another division the court deems appropriate,\u201d<\/em> the lawsuit reads.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">\u201c<em>Compel the defendant to disclose all licenses and copyright assignments related to \u2018Way Maker\u2019, account for all accrued fees, and pay the plaintiff his due share.<\/em><\/span><\/p>\n<p class=\"p2\"><em><span class=\"s1\">\u201cDeclare that the defendant failed in her statutory obligation to conclude written agreements with the plaintiff for his contributions to the sound recording; Affirm that the plaintiff\u2019s performer\u2019s rights were infringed upon.<\/span><\/em><\/p>\n<p class=\"p2\"><em><span class=\"s1\">\u201cIssue a perpetual injunction restraining the defendant from further reproduction, distribution, or public performance of \u2018Way Maker\u2019 or any adaptations thereof.\u201d<\/span><\/em><\/p>\n<p class=\"p2\"><span class=\"s1\">Oluwole, through Justin Ige, his legal representative, said he worked as a studio engineer on \u2018Way Maker\u2019<\/span><span class=\"s3\">, <\/span><span class=\"s1\">recording, mixing, and mastering the song.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><a href=\"https:\/\/www.withinnigeria.com\/entertainment\/2024\/11\/08\/paul-okoye-rudeboy-furiously-drags-twin-brother-peter-over-song-theft-threatens-management\/\">He also claimed that he created<\/a> and performed several instrumental accompaniments, including piano, strings, and synthesizers, without a transfer of his performer\u2019s rights.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Oluwole alleged that Sinach released the song without his consent or compensation. He also claimed that she had obtained licenses for the song without sharing the proceeds, describing her actions as \u201coppressive\u201d.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">In response, Sinach, through her counsel Emeka Etiaba of Etiaba Chambers, denied the producer\u2019s claims.<\/span><\/p>\n<figure id=\"attachment_197281\" aria-describedby=\"caption-attachment-197281\" style=\"width: 503px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2024\/11\/IMG_6694.jpeg\"><img decoding=\"async\" class=\"size-full wp-image-197281\" src=\"https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2024\/11\/IMG_6694.jpeg\" alt=\"\" width=\"503\" height=\"610\" srcset=\"https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2024\/11\/IMG_6694.jpeg 503w, https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2024\/11\/IMG_6694-247x300.jpeg 247w\" sizes=\"(max-width: 503px) 100vw, 503px\" \/><\/a><figcaption id=\"caption-attachment-197281\" class=\"wp-caption-text\">Sinach<\/figcaption><\/figure>\n<p class=\"p2\"><span class=\"s1\">The singer maintained that she had achieved global recognition before \u2018Way Maker\u2019 and claimed sole authorship of the song. She said the song was composed, arranged, and performed with other artistes such as Nwabude Chude Arinze, before Oluwole\u2019s involvement.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Sinach argued that the Oluwole\u2019s role was limited to mixing the master recording, a \u201cservice for which he was paid $300\u201d.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">She denied any obligation to establish a written agreement with him and maintained that he is not entitled to performer\u2019s rights, copyright, or publishing royalties.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">The trial, which began on November 27, 2024, was adjourned until January 29 and 30, 2025. This was after the court had taken arguments from the prosecution. The adjournment is to enable the defense to present its case.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Born Osinachi Kalu, Sinachi is the first singer to top the Billboard Christian Songwriter chart for 12 weeks.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">\u2018Way Maker\u2019 received three nominations and won \u2018Song of the Year\u2019 at the 51st GMA Dove Awards, making Sinach the first Nigerian to win the award.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Sinach has been slammed a N5 billion lawsuit over alleged copyright infringement of one of her hit songs.
