{"id":208018,"date":"2025-02-18T07:49:00","date_gmt":"2025-02-18T07:49:00","guid":{"rendered":"https:\/\/www.withinnigeria.com\/entertainment\/?p=208018"},"modified":"2025-02-18T07:49:00","modified_gmt":"2025-02-18T07:49:00","slug":"alleged-fraud-case-im-ready-to-prove-my-innocence-in-court-mercy-chinwos-ex-manager","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/entertainment\/2025\/02\/18\/alleged-fraud-case-im-ready-to-prove-my-innocence-in-court-mercy-chinwos-ex-manager\/","title":{"rendered":"Alleged fraud case: I\u2019m ready to prove my innocence in court \u2013 Mercy Chinwo\u2019s ex manager"},"content":{"rendered":"<ul>\n<li class=\"p1\"><strong>EeZee Tee has reaffirmed his commitment to proving his innocence in the fraud case filed against him.<\/strong><\/li>\n<li class=\"p1\"><strong><span class=\"s1\">The case was brought before the court by the Economic and Financial Crimes Commission (EFCC).<\/span><\/strong><\/li>\n<li class=\"p1\"><strong><span class=\"s1\">Mercy Chinwo\u2019s ex manager\u2019s made this known through his lawyer on Monday as the court upheld its bench warrant against the former, following his absence in court.<\/span><\/strong><\/li>\n<\/ul>\n<hr \/>\n<p class=\"p1\"><span class=\"s1\">Music producer, Ezekiel Onyedikachi popularly known as EeZee Tee on Monday affirmed his readiness to prove his innocence in the fraudulent conversion charge filed against him by the Economic and Financial Crimes Commission, EFCC.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><a href=\"https:\/\/www.withinnigeria.com\/entertainment\/2025\/01\/26\/judikay-walks-away-from-alleged-fraud-case-against-eezee-conceptz\/\">Onyedikachi<\/a> gave the assurance through his lawyer, Dr Monday Ubani, SAN, when the matter came up for hearing before a Federal High Court in Lagos.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">When the case was called, Ubani announced an appearance for the defendant, while Mr Rotimi Oyedepo (SAN) appeared for the prosecution.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Ubani, then informed the court he had filed two separate preliminary objections to the charge but would be withdrawing.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">When the Presiding Judge, Justice Alexander Owoeye inquired about the whereabout of the defendant, Ubani told the court that he received a call from the defendant, who said he had a terrible accident that morning.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">He however assured the court that his client will be available at the next date to take his plea and prove his innocence.<\/span><\/p>\n<figure id=\"attachment_208020\" aria-describedby=\"caption-attachment-208020\" style=\"width: 1204px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2025\/02\/IMG_0880.jpeg\"><img decoding=\"async\" class=\"size-full wp-image-208020\" src=\"https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2025\/02\/IMG_0880.jpeg\" alt=\"\" width=\"1204\" height=\"1240\" srcset=\"https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2025\/02\/IMG_0880.jpeg 1204w, https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2025\/02\/IMG_0880-291x300.jpeg 291w, https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2025\/02\/IMG_0880-994x1024.jpeg 994w, https:\/\/www.withinnigeria.com\/entertainment\/wp-content\/uploads\/sites\/6\/2025\/02\/IMG_0880-768x791.jpeg 768w\" sizes=\"(max-width: 1204px) 100vw, 1204px\" \/><\/a><figcaption id=\"caption-attachment-208020\" class=\"wp-caption-text\">EeZee Tee<\/figcaption><\/figure>\n<p class=\"p1\"><span class=\"s1\">When Ubani sought to move his preliminary objection to the charge, the court declined on the grounds that he cannot be heard, until the defendant appears before the court.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Justice Owoeye held that the court had not assumed jurisdiction over the case, since the plea of the defendant had not been taken.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">On his part, the prosecutor, citing provisions of sections 396(2) of the Administration of Criminal Justice Act, as well as judicial authorities of State vs Achara and Frn vs Yahaya Bello, urged the court not to hear the defence. He said:<\/span><\/p>\n<blockquote>\n<p class=\"p1\"><span class=\"s1\">\u201cMy lord, it is a show of shame and outright disrespect for this court, for the defendant to be absent on three different occasions in a criminal trial.\u201d<\/span><\/p>\n<\/blockquote>\n<p class=\"p1\"><span class=\"s1\">Besides, he told the court that if actually the defendant was indisposed as represented by counsel, then it ought to be deposed by way of affidavit, to be shown as proof before the court.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In the circumstance, Oyedepo prayed the court to issue a bench warrant to compel the attendance of the defendant before the court, adding that same is important to protect the integrity of the court.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Although defence counsel objected to the grant of a bench warrant by the court, and undertook to personally produce the defendant on his honour, the prosecution argued that defence\u2019s honour or intergrity was not in issue.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Oyedepo, maintained that the court issue a legal instrument, compelling the appearance of the defendant.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In a short ruling, the court held that from the court\u2019s record, the earlier bench warrant by the court still subsist as it had not been withdrawn.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The court consequently, held that the defendant is to appear in court on the next adjourned date for his arraignment, either by the subsisting bench warrant, or by production by his defence counsel.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Based on agreement of counsel, the court adjourned the case until March 6, for arraignment.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>EeZee Tee has reaffirmed his commitment to proving his innocence in the fraud case filed against him.
