{"id":68671,"date":"2022-03-17T09:53:49","date_gmt":"2022-03-17T09:53:49","guid":{"rendered":"https:\/\/www.withinnigeria.com\/entertainment\/?p=68671"},"modified":"2022-03-17T09:53:49","modified_gmt":"2022-03-17T09:53:49","slug":"jussie-smollett-released-from-jail-amid-appeal-on-charges-he-faked-hate-crime","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/entertainment\/2022\/03\/17\/jussie-smollett-released-from-jail-amid-appeal-on-charges-he-faked-hate-crime\/","title":{"rendered":"Jussie Smollett released from jail amid appeal on charges he faked hate crime"},"content":{"rendered":"<p>Hours after an Illinois state appellate court ruled he could go free while his lawyers appeal <a href=\"https:\/\/www.withinnigeria.com\/entertainment\/2022\/03\/11\/actor-jussie-smollett-sentenced-to-150-days-in-jail-for-staging-hate-crime-against-himself-video\/\">his conviction for staging a hate crime, Jussie Smollett<\/a> has regained his freedom.<\/p>\n<p>The 39 years old actor, was released from jail in Chicago on Wednesday March 16.<\/p>\n<p>Smollett who was flanked by five large men, said nothing as he was ushered into a light-colored SUV that drove away from the Cook County Detention Center around 8 p.m. local time.<\/p>\n<p>Smollett had been behind bars for six days \u2013 during which time lawyers said he did not eat and consumed only ice water \u2013 after being sentenced to five months in jail for being found guilty on five counts of felony disorderly conduct for lying to police.<\/p>\n<p>Defense lawyers argued that Smollett was unconstitutionally charged twice for the same crime because charges against him were dropped in 2019 in connection with his alleged false report that bigoted fans of President Trump attacked him with a noose and bleach in 2018.<\/p>\n<p>He was brought up on new charges a year later under Illinois\u2019 disorderly conduct statute after a special prosecutor looked into the case amid national outrage. A jury then found that the former \u201cEmpire\u201d actor, who is black and gay, had paid two men to beat him up in the hopes of raising his public profile.<\/p>\n<p>\u201cWhen this case was initially reindicted, when this case was prosecuted, when this case was sentenced, I wondered to myself if Chicago had succeeded from the union because you can not punish someone twice,\u201d lead defense lawyer Nenye Uche told reporters outside the jail.<\/p>\n<p>Smollett\u2019s lawyers filed an emergency motion to postpone his sentence on Monday and an appellate judge found that because Smollett had been convicted of \u201cnon-violent\u201d offenses, the court would allow him to be released from a Chicago jail on a $150,000 individual bond during the appeal, according to the court order.<\/p>\n<p>Under the terms of the I-Bond, Smollett would not have to dig into his pockets to get out of jail, and would only owe money if he skipped his court dates.<\/p>\n<p>Uche and three other defense lawyers told reporters they believed the second case and sentence was \u201cunconstitutional\u201d and \u201cracist,\u201d arguing that Smollett was \u201cpersecuted\u201d for making a complaint against purported white assailants.<\/p>\n<p>\u201cMultiple false reports are made against black men all over the country. Nobody cares,\u201d the lawyer said.<\/p>\n<p>\u201cWe\u2019ve been complaining about the disparate treatment of African Americans in the judicial system. Should black men be walked into jail for a class 4 felony? Shame on you if you think they should.\u201d<\/p>\n<p>Special prosecutor Dan Webb opposed Smollett\u2019s release, claiming there was \u201cno emergency that warrants the extraordinary relief of staying\u201d the sentence.<\/p>\n<p>Smollett did not provide any real proof that he was in danger and used \u201ccursory, woefully undeveloped arguments\u201d to sway the court, Webb wrote in the state\u2019s response to the motion for release.<\/p>\n<p>Lawyers had claimed Smollett was at risk of a bad case of COVID-19 in jail because he is immunocompromised and had been receiving threats over his high-profile conviction.<\/p>\n<p>He was moved to a different jail cell with surveillance and was kept away from other inmates following Monday\u2019s motion.<\/p>\n<p>The experience was so traumatic that Smollett \u2018\u2018nearly lost faith in our justice system\u2019 and couldn\u2019t eat, Uche said.<\/p>\n<p>\u201cMaybe being in a cage for a class four is enough to make you not want to eat,\u201d Uche said.<\/p>\n<p>The actor maintained his innocence during the trial and told the court that he was in danger of being killed in jail in an outburst during his sentencing.<\/p>\n<p>His next court date will be determined when defense lawyers file their non-emergency appeal.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Hours after an Illinois state appellate court ruled he could go free while his lawyers appeal his conviction for staging a hate crime, Jussie Smollett has regained his freedom.
