{"id":84481,"date":"2022-06-09T14:02:54","date_gmt":"2022-06-09T14:02:54","guid":{"rendered":"https:\/\/www.withinnigeria.com\/entertainment\/?p=84481"},"modified":"2022-06-09T14:06:54","modified_gmt":"2022-06-09T14:06:54","slug":"covid-19-court-strikes-out-suit-challenging-funke-akindele-jjc-skillz-conviction","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/entertainment\/2022\/06\/09\/covid-19-court-strikes-out-suit-challenging-funke-akindele-jjc-skillz-conviction\/","title":{"rendered":"Court strikes out suit challenging Funke Akindele, JJC Skillz\u2019 conviction"},"content":{"rendered":"<p class=\"p1\">A lawsuit seeking to\u00a0set aside the conviction of Nollywood actress Funke Akindele, her husband, Abdul\u00a0Rasheed Bello &#8211;\u00a0JJC Skillz and 236 others who were prosecuted for violating Lagos state\u2019s 2020 lockdown and social distancing order to check the spread of Covid-19, has been thrown out by a\u00a0Federal High Court sitting in Lagos.<\/p>\n<p class=\"p1\"><span class=\"s1\">Recall that\u00a0<a href=\"https:\/\/www.withinnigeria.com\/entertainment\/2022\/04\/04\/funke-akindele-bello-showers-encomiums-on-husband-jjc-skillz-as-he-clocks-45\/\">Akindele and her husband<\/a> were convicted on April 6, 2020, by the Lagos State Magistrates\u2019 Court in Ogba, days after they held a crowded house birthday party in violation of\u00a0Lagos State\u2019s social distancing order.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Justice Akintayo Aluko who presided over the case brought to the court by\u00a0Lagos-based lawyer, Olukoya Ogungbeje, who challenged the constitutionality of the Lagos State Infectious Diseases (Emergency Prevention) Regulations 2020 pursuant to which Akindele, her husband and 236 others were convicted and sentenced, held that the suit was incompetent and disclosed no reasonable cause of action.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Ogungbeje in the lawsuit\u00a0marked FHC\/L\/CS\/588\/2020, which has the\u00a0Lagos State Government, Attorney-General of Lagos State, Commissioner of Police, Lagos State and the Inspector-General of Police as defendants, had\u00a0also sought, among others, an order compelling the Respondents jointly and severally to tender a public apology in three widely read newspaper publications to persons\/Nigerian arrested, arraigned, tried, convicted and sentenced.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The Nation reported that the defendants argued that\u00a0Section 8 of the Quarantine Act, 2004 allows the governor to make the regulations where the President of Nigeria had not made such regulations.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">They also noted that the regulation was made for public safety, public good and protection which is larger and far greater than that of an individual such as the applicant.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Delivering judgement on the case,\u00a0Justice Aluko said:<\/span><\/p>\n<blockquote>\n<p class=\"p1\"><span class=\"s1\">\u201cIn total, I hold that this suit has disclosed no reasonable cause of action against the Respondents.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThe instant suit is incompetent and the court lacks jurisdiction to adjudicate over same.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cAccordingly, this suit is hereby struck out for those reasons.\u201d<\/span><\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>A lawsuit seeking to\u00a0set aside the conviction of Nollywood actress Funke Akindele, her husband, Abdul\u00a0Rasheed Bello &#8211;\u00a0JJC Skillz and 236 others who were prosecuted for violating Lagos state\u2019s 2020 lockdown and social distancing order to check the spread of Covid-19, has been thrown out by a\u00a0Federal High Court sitting in Lagos.
