{"id":106783,"date":"2021-11-13T13:04:15","date_gmt":"2021-11-13T12:04:15","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=106783"},"modified":"2021-11-13T13:04:15","modified_gmt":"2021-11-13T12:04:15","slug":"vat-tussle-fg-considering-out-of-court-settlement-says-zainab-ahmed","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2021\/11\/13\/vat-tussle-fg-considering-out-of-court-settlement-says-zainab-ahmed\/","title":{"rendered":"VAT tussle: FG considering out-of-court settlement, says Zainab Ahmed"},"content":{"rendered":"<p>Minister of finance, budget and national planning, Zainab Ahmed has revealed that the federal government is considering political paths to resolve the ongoing value-added tax (VAT) tussle.<\/p>\n<p>This revelation was made on Friday by the finance minister<span data-preserver-spaces=\"true\"> during an interview on Channels Television.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">In the last few months, the FIRS and some state governments engaged in a legal tussle over the jurisdiction of VAT collection.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Rivers and Lagos state governments enacted laws and called for decentralisation of <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/11\/12\/usifo-ataga-how-chidinma-allegedly-used-american-private-numbers-to-negotiate-for-apartment-witness\/\">VAT<\/a> collection, while some states want centralised collection.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The legal tussle followed the judgment of the federal high court in Port Harcourt, which restrained the FIRS from collecting VAT and personal income tax (PIT) in Rivers state.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">At the lower court, the FIRS had appealed for a stay of execution, but the court dismissed it on the basis that it would \u201cnegate the principle of equity\u201d.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Consequently, FIRS went to the court of appeal \u2014 the court ordered both Rivers and Lagos states to maintain status quo over<\/span><span data-preserver-spaces=\"true\">\u00a0the collection of VAT until the determination of the suit.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Not satisfied with the injunction, the Rivers state government filed the matter before the supreme court. No date<\/span><span data-preserver-spaces=\"true\">\u00a0has been fixed for the hearing of the case at the apex court.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Speaking during the interview, the finance minister said the federal government was seeking a positive political solution to the issue.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cI have to do this carefully because they are issues in court, and I am not supposed to be talking about issues in court,\u201d she said.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cBut, I do hope that this problem can be solved by sitting on the table, not on the pages of newspapers, not disagreements in court because it is possible to solve it on the table.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThere\u2019s a lot of effort going on right now. I said I didn\u2019t want to discuss it because it is in court so I have to be careful.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cYes, there will be a positive political solution.
