{"id":13647,"date":"2021-03-26T14:52:41","date_gmt":"2021-03-26T13:52:41","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=13647"},"modified":"2021-03-26T14:52:41","modified_gmt":"2021-03-26T13:52:41","slug":"police-release-american-nurse-after-detaining-her-for-44-days","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2021\/03\/26\/police-release-american-nurse-after-detaining-her-for-44-days\/","title":{"rendered":"Police release American nurse after detaining her for 44 days"},"content":{"rendered":"<p>44 days after, American nurse identified as Kari-Ann O&#8217;Rourke who was detained has been released from police custody.<\/p>\n<p>Recall that the American nurse had filed a lawsuit against\u00a0the Commissioner of Police in Lagos, Hakeem Odumosu, and the Deputy Commissioner of Police in charge of State Criminal Investigation Department, Panti, Yaba, Adegoke Fayoade over her \u2018unlawful and indefinite\u2019 detention.<\/p>\n<p>The nurse in the lawsuit filed before the federal high court in Lagos through her counsel\u00a0Ebun-Olu Adegboruwa, disclosed that she was arrested on February 9 and has been detained indefinitely over the death of her partner.<\/p>\n<p>Her lawyer, Ebun-Olu Adegboruwa told newsmen that she was released on Wednesday March 24.<\/p>\n<p>He also disclosed that the Directorate of Public Prosecutions (<em>DPP<\/em>) in their advice said the office shall not prosecute his client\u00a0for the <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/03\/26\/efcc-arraigns-ex-bank-manager-over-alleged-n14m-fraud-in-uyo\/\">offences<\/a> of conspiracy to murder as\u00a0the medical report attached to the duplicate case file establishes that the cause of the deceased\u2019s death were acute cardiac failure and hypertensive heart disease.<\/p>\n<p>Adegboruwa said;<\/p>\n<p><span style=\"text-transform: initial\">\u201cIn the course of time, Kari Ann\u2019s lawyer discovered, upon further investigation, that the case file had been forwarded to the Lagos State Ministry of Justice a long ago and that a legal opinion had been issued by the Director of Public Prosecutions, to the extent that there was no prima facie case worthy of prosecution.<\/span><\/p>\n<p>\u201cIn the Legal Advice dated March 5, 2021, and signed by the DPP, it was stated as follows:<\/p>\n<p>\u201cThe medical report attached to the duplicate case file establishes that the cause of the deceased\u2019s death were acute cardiac failure and hypertensive heart disease.<\/p>\n<p>\u201cThey should therefore be discharged and released if still in custody, as there is no case to be established against them from the facts presented in the duplicate case file.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>44 days after, American nurse identified as Kari-Ann O&#8217;Rourke who was detained has been released from police custody.
