{"id":152310,"date":"2022-02-22T13:41:48","date_gmt":"2022-02-22T12:41:48","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=152310"},"modified":"2022-02-22T13:41:48","modified_gmt":"2022-02-22T12:41:48","slug":"abba-kyari-court-refuses-application-of-bail-on-health-grounds","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2022\/02\/22\/abba-kyari-court-refuses-application-of-bail-on-health-grounds\/","title":{"rendered":"Abba Kyari: Court refuses application of bail on health grounds"},"content":{"rendered":"<p>Justice Inyang Eden Ekwo of the Federal High Court in Abuja, has denied application of bail on health grounds by embattled former head of the Police Intelligence Response Team, IRT, Abba Kyari.<\/p>\n<p>WITHIN NIGERIA had reported that <a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/02\/21\/detained-dcp-abba-kyari-drags-fg-to-court-seeks-release-from-ndlea-custody\/\" target=\"_blank\" rel=\"noopener\">Kyari had dragged the Federal Government<\/a> before the court over his continued detention by the National Drug Law Enforcement Agency (NDLEA) over his alleged involvement in drug trafficking.<\/p>\n<p>The judge rather ordered that <a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/02\/20\/drug-trafficking-parade-abba-kyari-like-the-criminal-he-is-reno-omokri\/\" target=\"_blank\" rel=\"noopener\">Kyari<\/a> put the FG on notice of the existence of the suit he instituted against it.<\/p>\n<p>Kyari, in his suit marked FHC\/ABJ\/CS\/182\/22, prayed the court to compel the <a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/02\/14\/how-we-filmed-abba-kyari-offering-61400-cash-for-release-of-25kg-of-cocaine-ndlea\/\" target=\"_blank\" rel=\"noopener\">NDLEA<\/a> to grant him bail on health grounds, pending the hearing and determination of his fundamental right enforcement application.<\/p>\n<p>In an ex-parte motion, he filed through his lawyer, Mrs. P. O. Ikenna, Kyari told the court that he was being held \u201con the basis of a false allegation leveled against him.\u201d<\/p>\n<p>However, when the case was called up, Justice Inyang Ekwo noted that the suit contained some averments that would require Federal Government\u2019s response.<\/p>\n<p>\u201cUpon studying the process of the applicant and averments in support thereon, I am of the opinion that the respondent should be put on notice,\u201d the judge held.<\/p>\n<p>Justice Ekwo ordered that all the relevant processes be served on Federal Government, which was cited as the sole respondent, even as he adjourned the case till February 24 for hearing.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Justice Inyang Eden Ekwo of the Federal High Court in Abuja, has denied application of bail on health grounds by embattled former head of the Police Intelligence Response Team, IRT, Abba Kyari.
