{"id":158817,"date":"2022-03-08T13:16:24","date_gmt":"2022-03-08T12:16:24","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=158817"},"modified":"2022-03-08T13:16:24","modified_gmt":"2022-03-08T12:16:24","slug":"court-cant-stop-nassembly-from-deleting-clause-disenfranchising-appointees-says-lawan","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2022\/03\/08\/court-cant-stop-nassembly-from-deleting-clause-disenfranchising-appointees-says-lawan\/","title":{"rendered":"Court can&#8217;t stop n&#8217;assembly from deleting clause &#8216;disenfranchising&#8217; appointees, says Lawan"},"content":{"rendered":"<p>Ahmad Lawan, Nigeria&#8217;s senate president has disclosed that the judiciary can not stop the national assembly from carrying out its duties.<\/p>\n<p>This was in response to an order of the\u00a0Abuja federal high court temporarily restraining the national assembly from deleting section 84 (12) of the newly-amended electoral act.<\/p>\n<p>When President Muhammadu Buhari signed the bill into law, he said the clause disenfranchises political appointees.<\/p>\n<p>He later sent a formal request to the national assembly for it to delete the clause.<\/p>\n<p>Speaking on the floor of the senate on Tuesday, Lawan said it is the national assembly\u2019s exclusive right to consider any request either from the president or Nigerians.<\/p>\n<p>\u201cThe judge in a ruling on an ex-parte application by the opposition <a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/03\/08\/why-obasekis-supporters-do-not-feel-welcome-in-pdp-shaibu\/\">Peoples Democratic Party<\/a> (PDP) said the electoral act, having become valid law, could not be altered without following the due process of law,\u201d the senate president said.<\/p>\n<p>\u201cI find it very necessary to talk at this point because with the constitution of the Federal Republic of Nigeria, our governance system is based on the presidential system of government where there is a clear cut separation of powers and exercise of powers.<\/p>\n<p>\u201cThe judiciary under no circumstance can stop the legislature, the national assembly from performing its legislative duties. We know what our due processes are.<\/p>\n<p>\u201cJust like we won\u2019t venture into what the judiciary does, the judiciary should understand that we have our processes. I believe the members of the national assembly know their work, know their onions and would do that is right.<\/p>\n<p>\u201cThis is due process, we are not doing anything outside the law.
