{"id":161456,"date":"2022-03-14T04:00:36","date_gmt":"2022-03-14T03:00:36","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=161456"},"modified":"2022-03-14T04:00:36","modified_gmt":"2022-03-14T03:00:36","slug":"edo-father-remanded-for-defiling-15-month-old-daughter","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2022\/03\/14\/edo-father-remanded-for-defiling-15-month-old-daughter\/","title":{"rendered":"Edo father remanded for defiling 15-month-old daughter"},"content":{"rendered":"<p>The Justice Geraldine Imadegbelo of the Edo State High Court has one ordered that Yahaya Oisamaiye to be remanded in a custodial centre for allegedly defiling his 15-month-old daughter.<\/p>\n<p>The judge gave the order pending legal advice from the Directorate of Public Prosecutions.<\/p>\n<p>The charge against the accused read, \u201cThat you, Yahaya Oisamaiye, on or about February 7, 2022, between 5am and 6am, on Brisbourne Iyamu Street, GRA, Benin City, in the Benin Judicial Division, did have unlawful <a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/02\/26\/update-13-year-old-boy-dies-after-he-was-sexually-assaulted-by-security-guard-in-edo\/\" target=\"_blank\" rel=\"noopener\">carnal knowledge<\/a> of (name withheld) aged 15 months, thereby committing an offence contrary to Section 4 and punishable under Section 5 (1) of the Edo State Violence Against Persons (Prohibition) Law 2021.\u201d<\/p>\n<p>Oisamaiye, however, pleaded not guilty to the charge.<\/p>\n<p>The police prosecutor, I. E. Ekibade, urged the court to remand Oisamaiye, citing the Administration of Criminal Justice Law of Edo State 2016.<\/p>\n<p>\u201cSection 293(1) provides that when a suspect is arrested for an offence which a magistrate\u2019s court has no jurisdiction to try shall within a reasonable time of arrest be brought before a high court for remand,\u201d Ekibade added.<\/p>\n<p>The defendant was represented by Dan Okoh (SAN), Musa Bello, Uwa Okoh and C.O.
