{"id":163914,"date":"2022-03-18T21:03:05","date_gmt":"2022-03-18T20:03:05","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=163914"},"modified":"2022-03-18T21:03:05","modified_gmt":"2022-03-18T20:03:05","slug":"nigeria-effects-court-judgement-allowing-appointees-contest-elections-while-in-office","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2022\/03\/18\/nigeria-effects-court-judgement-allowing-appointees-contest-elections-while-in-office\/","title":{"rendered":"Nigeria effects court judgement allowing appointees contest elections while in office"},"content":{"rendered":"<p>The Federal Government of Nigeria says the court judgement allowing political appointees to run for office will go into effect.<\/p>\n<p><a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/03\/17\/i-have-not-resigned-says-malami\/\" target=\"_blank\" rel=\"noopener\">Abubakar Malami<\/a>, Attorney General and Minister of Justice, made the government\u2019s position known in a statement Friday night.<\/p>\n<p>The AGF said he would act \u201caccordingly\u2026in line with the dictates of the law and the spirit of the judgment.\u201d<\/p>\n<p>Malami noted that the judgment will be recognized by the government printers \u201cin printing the Electoral Act\u201d.<\/p>\n<p>\u201cThe Act will be gazetted factoring the effect of the judgment into consideration and deleting the constitutionally offensive provision accordingly.<\/p>\n<p>\u201cThe provision of Section 84(12) of the Electoral Act 2022 is not part of our law and will be treated accordingly.\u201d<\/p>\n<p>President Muhammadu Buhari, while signing the Electoral Bill into law in February, asked the National Assembly to delete the section.<\/p>\n<p>It reads: \u201cNo political appointee at any level shall be voting delegate or be voted for at the Convention or Congress of any political party for the purpose of the nomination of candidates for any election.\u201d<\/p>\n<p>Buhari argued that this constitutes a disenfranchisement of serving political office holders because they cannot vote or be voted for at party conventions or congresses.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Federal Government of Nigeria says the court judgement allowing political appointees to run for office will go into effect.
