{"id":167380,"date":"2022-03-25T17:12:08","date_gmt":"2022-03-25T16:12:08","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=167380"},"modified":"2022-03-25T17:12:08","modified_gmt":"2022-03-25T16:12:08","slug":"extradition-nnamdi-kanu-files-n25bn-suit-against-fg","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2022\/03\/25\/extradition-nnamdi-kanu-files-n25bn-suit-against-fg\/","title":{"rendered":"Extradition: Nnamdi Kanu files N25bn suit against FG"},"content":{"rendered":"<p>Detained leader of the Indigenous People of Biafra, Nnamdi Kanu, has filed a fresh suit at a Federal High Court sitting in Umuahia, Abia State, over his extradition from Kenya in June 2021.<\/p>\n<p>Kanu in the suit filed by his Special Counsel, Mr Aloy Ejimakor, according to a statement on Friday, argued that his extradition was \u201cunconstitutional\u201d.<\/p>\n<p>The statement was titled, \u2018Nnamdi Kanu approaches Federal High Court, Umuahia to enforce his fundamental rights against unlawful expulsion\u2019.<\/p>\n<p>He demanded N25 billion as damages for \u201cthe physical, mental, emotional, psychological, property\u201d loss he suffered during his extradition.<\/p>\n<p>The lawyer explained that Nnamdi Kanu approached a Federal High Court after the High Court of Abia State on January 19, 2022, declined jurisdiction on grounds that rendition, being related to extradition, lies within the exclusive jurisdiction of the Federal High Court.<\/p>\n<p>The <a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/03\/24\/how-buhari-government-and-dss-are-subjecting-nnamdi-kanu-to-unimaginable-torture-ipob-tells-un\/\" target=\"_blank\" rel=\"noopener\">IPOB leader<\/a> sought \u201cA declaration that the arrest of the Applicant in Kenya by the Respondents\u2019 agents without due process of law is arbitrary, and the Respondents\u2019 enforced disappearance of the Applicant for eight days and their refusal to produce the Applicant before a Kenyan Court for the purpose of Applicant\u2019s extradition is illegal, unlawful, unconstitutional and amount to infringement of the Applicant\u2019s fundamental right against arbitrary arrest, to his personal liberty and to fair hearing as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter.<\/p>\n<p>\u201cA declaration that the detention of the Applicant in a non-official secret facility in Kenya and the torture of the Applicant in Kenya by the Respondents\u2019 agents is illegal, unlawful, unconstitutional and amount to infringement of the Applicant\u2019s fundamental right against unlawful detention, torture and to fair hearing, as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter).<\/p>\n<p>\u201cA declaration that, pursuant to Article 12(4) of the Charter, the expulsion (or extraordinary rendition) of the Applicant from Kenya to Nigeria by the Respondents without a decision taken in accordance with the law of Kenya is illegal, unlawful, unconstitutional and amounts to infringement of the Applicant\u2019s fundamental right to fair hearing and not to be expelled from a State Party to the Charter except by virtue of a decision taken in accordance with the law, as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter.<\/p>\n<p>\u201cA declaration that any criminal prosecution of the Applicant the purpose of which the Respondents unlawfully expelled the Applicant from Kenya to Nigeria is illegal, unlawful, unconstitutional and amounts to infringement of the Applicant\u2019s fundamental right to fair hearing, as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter.<\/p>\n<p>\u201cAn order of injunction restraining and prohibiting the Respondents from taking any further step in any criminal prosecution of the Applicant enabled by the said unlawful expulsion of the Applicant from Kenya to Nigeria.<\/p>\n<p>\u201cAn order mandating and compelling the Respondents to forthwith restitute or otherwise restore the Applicant to his liberty, same being his state of being as of 19th June, 2021; and to thereupon repatriate the Applicant to his country of lawful domicile (to wit: the United Kingdom) to await the outcome of any formal request the Respondents may file before the competent authorities in Britain for the lawful extradition of the Applicant to Nigeria.<\/p>\n<p>\u201cAn order mandating and compelling the Respondents to issue an official Letter of Apology to the Applicant for the infringement of his fundamental rights;
