{"id":168747,"date":"2022-03-28T17:13:35","date_gmt":"2022-03-28T16:13:35","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=168747"},"modified":"2022-03-28T17:13:35","modified_gmt":"2022-03-28T16:13:35","slug":"alleged-n6bn-fraud-court-reduces-momphas-bail-sum-from-n200m-to-n25m","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2022\/03\/28\/alleged-n6bn-fraud-court-reduces-momphas-bail-sum-from-n200m-to-n25m\/","title":{"rendered":"Alleged N6bn fraud: Court reduces Mompha\u2019s bail sum from N200m to N25m"},"content":{"rendered":"<p>An Ikeja Special Offences Court on Monday reduced from N200 million to N25 million, the bail sum for social media celebrity, Ismaila Mustapha (alias Mompha), charged with six billion Naira money laundering.<\/p>\n<p>The News Agency of Nigeria (NAN) reports that Justice Mojisola Dada made the ruling following a prayer by defence counsel, Mr Gboyega Oyewole (SAN), and submission by prosecution counsel, Mr Rotimi Oyedepo.<\/p>\n<p>Dada had on Jan.18 granted Mompha bail in the sum of N200 million and two sureties.<\/p>\n<p>However, on Monday, she held: \u201cThe defendant is admitted to <a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/01\/18\/just-in-court-grants-mompha-n200-million-bail\/\" target=\"_blank\" rel=\"noopener\">bail<\/a> of N25 million with two sureties in like sum.<\/p>\n<p>\u201cOne of the sureties must have a landed property worth N50 million within the court\u2019s jurisdiction.<\/p>\n<p>\u201cThe defendant shall be temporarily released to defence counsel only for two weeks pending perfection of the bail conditions.<\/p>\n<p>\u201cDefence counsel should also write an undertaking to that effect.\u201d<\/p>\n<p>Earlier, Oyewole tendered an application which was supported by a 13-paragraph affidavit to pray the court to lessen the bail conditions.<\/p>\n<p>\u201cMy lord, I have an application dated March 8, 2022, seeking the court\u2019s variation of the bail granted to the defendant.<\/p>\n<p>\u201cThe application is supported by a 13-paragraph affidavit which we adopted.<\/p>\n<p>\u201cWe seek the prosecution to see toward the possibility of some kind of restitutions but this is being tampered with because of detention.<\/p>\n<p>\u201cWe urge your lordship to consider the variation as proposed.<\/p>\n<p>The counsel said that the defendant had been on bail on a 22-count-charge before the Federal High Court and did not jump bail.<\/p>\n<p>Responding, Oyedepo had told the court that he was aware of the application and would leave it at the discretion of the court.<\/p>\n<p>\u201cMy lord, we are aware of the application. We have opposed it and gave conditions to the defendant.<\/p>\n<p>\u201cWeI leave it to my lord\u2019s discretion,\u201d he said.<\/p>\n<p>NAN reports that the case was initially scheduled for trial.<\/p>\n<p>Mompha and his company, Ismalob Global Investment Ltd., were arraigned on an eight-count charge by the Economic and Financial Crimes Commission on Jan. 12 .<\/p>\n<p>The charges include conspiracy to launder funds obtained through unlawful activity and laundering of funds obtained through unlawful activity.<\/p>\n<p>Other charges include retention of proceeds of criminal conduct, use of property derived from unlawful act, possession of document containing false pretence and failure to disclose assets and property.<\/p>\n<p>The court adjourned the case until April 6 for progress report on perfection of bail conditions.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>An Ikeja Special Offences Court on Monday reduced from N200 million to N25 million, the bail sum for social media celebrity, Ismaila Mustapha (alias Mompha), charged with six billion Naira money laundering.
