{"id":182906,"date":"2022-04-25T20:58:01","date_gmt":"2022-04-25T19:58:01","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=182906"},"modified":"2022-04-25T20:58:01","modified_gmt":"2022-04-25T19:58:01","slug":"lawyer-drags-buhari-to-court-over-hardship-suffered-by-nigerians-during-fuel-scarcity","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2022\/04\/25\/lawyer-drags-buhari-to-court-over-hardship-suffered-by-nigerians-during-fuel-scarcity\/","title":{"rendered":"Lawyer drags Buhari to court over hardship suffered by Nigerians during fuel scarcity"},"content":{"rendered":"<p>Festus Ogun, a Lagos-based legal practitioner, has instituted a legal action against President Muhammadu Buhari over the recent petrol scarcity in the country.<\/p>\n<p>Ogun announced the litigation in a statement on Monday.<\/p>\n<p>He accused Buhari of putting Nigerians through adversity, agony and excessive pain during the fuel scarcity that hit the country in February.<\/p>\n<p>In February, the Nigerian Midstream and Downstream Petroleum Regulatory Authority (NMDPRA) had announced that marketers <strong><a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/03\/31\/nmdpra-reveals-how-its-restored-normalcy-in-petrol-distribution-after-scarcity\/\">had imported petrol with methanol content above national specification<\/a><\/strong> into the country.<\/p>\n<p>Amid efforts to recall the off-spec petrol from circulation, the supply chain was disrupted, causing long queues at filling stations until April.<\/p>\n<p>In the suit marked FHC\/L\/CS\/743\/22 and filed before a federal high court in Lagos, Ogun said the petroleum sector has not been run efficiently.<\/p>\n<p>He prayed the court to declare that Buhari\u2019s dual position as president and petroleum minister is unconstitutional.<\/p>\n<p>\u201cI solemnly believe that the gross inefficiency and mismanagement in the petroleum sector, that led to the fuel scarcity, is avoidable if the president was not holding the dual position of petroleum minister in violation of Section 138 of the 1999 Constitution,\u201d the statement reads.<\/p>\n<p>\u201cI believe that the president\u2019s continuous serving as petroleum minister is not only illegal and unconstitutional, it is inimical to our economic growth and likely to occasion future scarcity and inefficiency that will affect the country and its good people.<\/p>\n<p>\u201cI make bold to say that it is practically and legally impossible for the President to hold his elected position, that comes with enormous responsibilities, contemporaneously with the position of petroleum minister. It has no basis in law, logic and politics.<\/p>\n<p>\u201cIf Nigerians suffered that heavily during the fuel scarcity, the president must be answerable for it.
