{"id":183487,"date":"2022-04-27T21:54:54","date_gmt":"2022-04-27T20:54:54","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=183487"},"modified":"2022-04-27T21:54:54","modified_gmt":"2022-04-27T20:54:54","slug":"defection-apc-to-challenge-removal-of-member-by-adamawa-assembly-in-court","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2022\/04\/27\/defection-apc-to-challenge-removal-of-member-by-adamawa-assembly-in-court\/","title":{"rendered":"Defection: APC to challenge removal of member by Adamawa Assembly in court"},"content":{"rendered":"<p>The All Progressives Congress (APC) says the removal of a member of the Adamawa State House of Assembly, Ayuba Kwada, because he defected to the party from Peoples Democratic Party (PDP) is illegal.<\/p>\n<p>Twelve PDP members and one APC member of the 25-member of the state legislative body on\u00a0 Wednesday morning declared Ayuba\u2019s seat vacant.<\/p>\n<p>Ayuba had announced his defection from the PDP to the APC last week.<\/p>\n<p>Reacting to the development, the <strong><a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/04\/22\/wike-to-adamawa-delegates-give-me-50-of-votes-it-wont-be-fair-to-defeat-atiku-at-home\/\">Adamawa<\/a><\/strong> State chapter of the APC condemned the sacking of Ayuba.<\/p>\n<p>In a statement on Wednesday, evening the party said it had instructed its lawyers to take legal action to contest it.<\/p>\n<p>It added that the power to declare a lawmaker&#8217;s seat vacant is only vested in the judiciary<\/p>\n<p>\u201cAs a law-abiding political party, we are aware that it\u2019s only the court that has inherent powers to declare a seat vacant,\u201d the APC said in its statement signed by the state Publicity Secretary, Hon. Mohammed Abdullahi.<\/p>\n<p>\u201cBy this statement, the legal Adviser of our Great Party has been mandated to commence the legal action,\u201d the APC added.<\/p>\n<p>The party, which recalled that an APC member, Musa Bororo, had earlier last year defected to the PDP, said part of its demand would be that the court should declare Bororo\u2019s seat vacant.<\/p>\n<p>Other actions of the House which the APC said it had resolved to challenge in court include the procedure followed in reconvening the House which had been on recess.<\/p>\n<p>\u201cAllowing personal interest to interfere with official conduct\u201d and \u201cThe glaring injustice and partisanship in declaring Hon Joseph Ayuba Kwada\u2019s seat vacant,\u201d are the other actions of the Adamawa State House of Assembly that the APC said it would challenge.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The All Progressives Congress (APC) says the removal of a member of the Adamawa State House of Assembly, Ayuba Kwada, because he defected to the party from Peoples Democratic Party (PDP) is illegal.
