Mr.\u00a0Olanrewaju\u00a0Adeniran\u00a0and\u00a0Fatima\u00a0were\u00a0never\u00a0married\u00a0for\u00a0the\u00a027\u00a0years\u00a0they\u00a0lived\u00a0together\u00a0because\u00a0no\u00a0dowry\u00a0was\u00a0paid,\u00a0according\u00a0to\u00a0a\u00a0Mapo\u00a0Grade\u00a0“A”\u00a0Customary\u00a0Court\u00a0in\u00a0Ibadan.<\/p>\n

The President of the court, Mrs. S.M. Akintayo, said that Nigerian law and custom said that the man had to pay a bride price to the wife’s parents for the marriage to be valid.<\/p>\n

Akintayo made her decision based on different parts of the law. She decided that Adeniran and Fatima’s marriage didn’t need to be dissolved in the first place because they didn’t have a dowry.<\/p>\n

She\u00a0went\u00a0on\u00a0to\u00a0say\u00a0that\u00a0other\u00a0basic\u00a0requirements\u00a0were\u00a0not\u00a0met\u00a0in\u00a0order\u00a0to\u00a0consider\u00a0Adeniran\u00a0and\u00a0Fatima’s\u00a0union\u00a0as\u00a0a\u00a0marriage.<\/p>\n

\u201cMerely asking whether Fatima loved Adeniran which Fatima\u2019s father did was not enough to validate their togetherness as customary marriage.<\/p>\n

\u201cIt is a wrong assumption to continue to believe that once there is a child or children between a man and a woman, they are husband and wife or married.<\/p>\n

\u201cNo, there is no marriage between them, they are only cohabiting, they are merely living together<\/a> in the same house,\u201d Akintayo said.<\/p>\n

The court\u2019s president, however, granted an order of perpetual injunction restraining Fatima from further harassing, disturbing, intimidating, and interfering in the life of Adeniran henceforth.<\/p>\n

Earlier, Adeniran, a retired civil servant and a resident of the Molade area in Ibadan had explained that his estranged wife was an unrepentant troublemaker and a nag.<\/p>\n

Adeniran submitted that his wife had been detained on eight separate occasions as a result of her violent conduct and repulsiveness towards in-laws, tenants, and neighbors in the community.<\/p>\n

\u201cMy brother who once accommodated us before I built my own house expelled us when he could no longer cope with Fatima\u2019s ineptitude.<\/p>\n

\u201cMy lord, Fatima no longer allows me to touch her anymore, she often tells me that I\u2019m smelling.
\na
\n\u201cWorst still, she vandalizes home appliances at any slightest provocation.<\/p>\n

\u201cShe usually accuses me of womanizing,\u201d the petitioner said.<\/p>\n

Fatima, a businesswoman had prayed the court not to put an end to their love.<\/p>\n

She, however, argued that her husband was a socialite and an adulterer.<\/p>\n

\u201cAdeniran has no fewer than eight concubines and some of them even came around to give me gifts anytime we did naming ceremonies.<\/p>\n
