{"id":200782,"date":"2022-07-02T14:59:03","date_gmt":"2022-07-02T13:59:03","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=200782"},"modified":"2022-07-02T15:05:06","modified_gmt":"2022-07-02T14:05:06","slug":"firs-can-collect-vat-from-lagos-hotel-owners-court-declares","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2022\/07\/02\/firs-can-collect-vat-from-lagos-hotel-owners-court-declares\/","title":{"rendered":"FIRS can collect VAT from Lagos hotel owners, court declares"},"content":{"rendered":"<p>The court of appeal sitting in Lagos has ruled that the Federal Inland Revenue Service (FIRS) can collect value-added tax (VAT) from Lagos hoteliers.<\/p>\n<p>The ruling was given on Friday by the court<span class=\"acssf62a8\">\u00a0following an appeal filed by the FIRS against the Lagos Hotel Owners Association of Nigeria.<\/span><\/p>\n<p>VAT is a consumption tax payable when goods are purchased and services are rendered.<\/p>\n<p>Recall that a federal high court in Lagos in 2019 barred the <a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/06\/23\/kwara-records-first-confirmed-case-of-monkey-pox\/\">FIRS<\/a> from<span class=\"acssf62a8\"> enforcing VAT provisions on goods and services consumed in hotels, restaurants, and event centres in Lagos state.<\/span><\/p>\n<p><span class=\"acssf62a8\">The court upheld the powers of the state government to charge and collect consumption tax from hotels, restaurants, and event centres within the state.<\/span><\/p>\n<p><span class=\"acssf62a8\">Displeased with the verdict, FIRS proceeded to the court of appeal and subsequently secured a stay of execution pending the outcome of the appeal filed.<\/span><\/p>\n<p><span class=\"acssf62a8\">In its ruling, the appeal court set aside the federal high court\u2019s judgement, affirming FIRS\u2019 authority to collect VAT from all taxpayers.<\/span><\/p>\n<p><span class=\"acssf62a8\">The appeal court also struck out a counter-claim filed by the Lagos government against FIRS.<\/span><\/p>\n<p><span class=\"acssf62a8\">There is an ongoing legal tussle between FIRS and some state governments on the issue of VAT collection.
