{"id":202029,"date":"2022-07-08T07:58:23","date_gmt":"2022-07-08T06:58:23","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=202029"},"modified":"2022-07-08T07:58:23","modified_gmt":"2022-07-08T06:58:23","slug":"bamise-court-orders-brt-driver-to-get-new-lawyer-urgently","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2022\/07\/08\/bamise-court-orders-brt-driver-to-get-new-lawyer-urgently\/","title":{"rendered":"Bamise: Court orders BRT driver to get new lawyer urgently"},"content":{"rendered":"<p>On Thursday, Justice Sherifat Sonaike of a Lagos State High Court sitting at Tafawa Balewa Square ordered the alleged killer of a BRT passenger to immediately retain a new attorney to prevent further delays in his case.<\/p>\n<p>The judge ruled that counsel for Andrew Ominnikoron, a <a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/03\/22\/bamise-ayanwola-court-remands-brt-driver-for-alleged-rape-murder-of-passenger\/\">BRT driver accused of murdering<\/a> the 22-year-old female passenger, had repeatedly failed to appear in court.<\/p>\n<p>Sonaike made the order following the absence of Ominnikoron\u2019s counsel, Mr Abayomi Omotubora, in court.<\/p>\n<p>Ominnikoron is on trial for the rape and murder of fashion designer Miss Oluwabamise Ayanwole.<\/p>\n<p>The judge directed the defendant to get new counsel by the next adjourned date.<\/p>\n<p>\u201cI have listened to the prosecution; I shall be directing at this stage that the defendant should avail himself of a counsel to continue his trial on the next adjourned date.<\/p>\n<p>\u201cIf he is unable to avail himself a lawyer on the next adjourned date, I will direct that the Legal Aid Council should take up his case.<\/p>\n<p>\u201cThe defendant\u2019s counsel, Omotubora, has been absent from court on several occasions.<\/p>\n<p>\u201cThis is unbecoming of a lawyer. This particular counsel has failed to come to court to conduct his trial, and this court strongly condemns it,\u201d the judge held.<\/p>\n<p>Lagos State Attorney-General and Commissioner for Justice, Mr Moyosore Onigbanjo (SAN), had appeared for prosecution on Thursday, informing the court that the case was for continuation of trial.<\/p>\n<p>According to Onigbanjo, the case was, on June 30, adjourned until July 7, due to absence of defence counsel.<\/p>\n<p>\u201cThis morning again the defence is not represented.<\/p>\n<p>\u201cI would be urging the court to ask the defendant for the whereabouts of his counsel before I make any necessary application,\u201d he said.<\/p>\n<p>Onigbanjo informed the court that prosecution had five witnesses in court to give evidence.<\/p>\n<p>He applied that the court should appoint a lawyer from the Office of the Public Defender (OPD) or from the Legal Aid Council (LAC) to defend the BRT driver.<\/p>\n<p>\u201cIt is clear that the defendant\u2019s counsel, who is aware of this date, did not deem it fit to inform the court that he would not be in court.<\/p>\n<p>\u201cThis is a capital offence and the defence counsel\u2019s conduct is just to frustrate this case,\u201d he submitted.<\/p>\n<p>The judge then asked the BRT driver if he could defend himself, and he said that he was ready to defend himself.<\/p>\n<p>Ominnikoron also said that he was not able to reach his counsel and was not aware that his counsel would not be in court<\/p>\n<p>However, Onigbanjo submitted: \u201cAlthough the defendant said he could defend himself, I will say the court should tread with caution.<\/p>\n<p>\u201cI would urge the court to appoint OPD or LAC to take over defence. I want a fair trial.\u201d<\/p>\n<p>Thus, Sonaike adjourned the case until Sept. 28 for continuation of trial.<\/p>\n<p>Omininikoron is facing a four-count charge bordering on rape and murder of Ayanwole, contrary to Sections 165, 223, 260 and 411 of the Criminal Law of Lagos State, 2015.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On Thursday, Justice Sherifat Sonaike of a Lagos State High Court sitting at Tafawa Balewa Square ordered the alleged killer of a BRT passenger to immediately retain a new attorney to prevent further delays in his case.
