{"id":207998,"date":"2022-08-04T14:08:39","date_gmt":"2022-08-04T13:08:39","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=207998"},"modified":"2022-08-04T14:08:39","modified_gmt":"2022-08-04T13:08:39","slug":"fccpc-disconnecting-customers-electricity-supply-without-10-day-notice-is-unlawful","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2022\/08\/04\/fccpc-disconnecting-customers-electricity-supply-without-10-day-notice-is-unlawful\/","title":{"rendered":"FCCPC: Disconnecting customers\u2019 electricity supply without 10-day notice is unlawful"},"content":{"rendered":"<p>The Federal Competition and Consumer Protection Commission (FCCPC) has stated that it is illegal for electricity distribution companies (DisCos) to disconnect customers from the power supply without a prior 10-day notice from the date of bill delivery.<\/p>\n<p>This was stated on Wednesday in Calabar by the executive vice-chairman of the commission, Babatunde <span data-preserver-spaces=\"true\">Irukera.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The regulation is contained in the Nigerian Electricity Regulatory Commission (NERC\u2019s) regulation<\/span><span data-preserver-spaces=\"true\">\u00a0on Connection and Disconnection Procedures for Electricity Service (CDPES).<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Expressing dissatisfaction with the service provided by Port Harcourt Electricity Distribution Company (PHEDC) in Calabar and its environs, Irukera said that investigation by the commission showed that PHEDC had not fared well in providing power supply to its consumers commensurate with their bills.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">He said that the reports they received on many issues included mass disconnection carried out by the company without recourse to the law.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cI want to convey to you the incredible displeasure of the people of Cross River, according to them, especially the governor, if they have their way, they will prefer that PHEDC does not operate in the state,\u201d Irukera said.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cIf this is the view about your business, then I don\u2019t think that business will survive.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThe massive disconnection of <a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/07\/02\/bandits-kill-20-abduct-25-women-in-kaduna-communities\/\">communities<\/a> because of debt is not only illegal, it is outrageous and an abuse of the people\u2019s right. Disconnecting the whole community is oppressive.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThere are people in that same community that are consistent with payment of bills, so it is unfair and an injustice to also disconnect them.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cAny business that cannot satisfy its consumers is preparing to die; allowing consumers to pay tariffs without commensurate <a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/07\/06\/nigerian-govt-announces-restructuring-of-five-electricity-companies\/\">electricity<\/a> supply is against the law.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThe problem of compelling consumers to pay electricity bills is tantamount to oppressing and extorting money illegally from consumers.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThe internal mechanism for assessing scorecard of electricity companies is not by a collection of tariffs, rather it is customer satisfaction that matters.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Irukera said a situation where DisCos cut power supply for days and still issues bills covering that same period was \u201cexploitative.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">He also explained that it was illegal for consumers to buy transformers that would later become the property of the DisCos.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Federal Competition and Consumer Protection Commission (FCCPC) has stated that it is illegal for electricity distribution companies (DisCos) to disconnect customers from the power supply without a prior 10-day notice from the date of bill delivery.
