{"id":218855,"date":"2022-09-28T05:31:53","date_gmt":"2022-09-28T04:31:53","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=218855"},"modified":"2022-09-28T05:31:53","modified_gmt":"2022-09-28T04:31:53","slug":"2023-court-annuls-all-ogun-pdp-primaries-orders-fresh-election","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2022\/09\/28\/2023-court-annuls-all-ogun-pdp-primaries-orders-fresh-election\/","title":{"rendered":"2023: Court Annuls All Ogun PDP Primaries, Orders Fresh Election"},"content":{"rendered":"<p>All the primaries conducted by the Peoples Democratic Party (PDP) ahead of next year\u2019s election have been nullified by a Federal High court in Abeokuta, Ogun State capital. <\/p>\n<p>The affected primaries include governorship, Senate, House of Representatives and the House of Assembly.<\/p>\n<p>The court, therefore, ordered conduct of fresh primaries for all the positions within 14 days.<\/p>\n<p>The court also stopped the <a href=\"https:\/\/www.withinnigeria.com\/news\/2022\/09\/26\/2023-inec-issues-strong-warning-to-parties-candidates-ahead-of-campaign\/\">Independent National Electoral Commission (INEC) <\/a>from recognising Hon. Ladi Adebutu as the governorship candidate of the party in the state.<\/p>\n<p>Justice O.O Oguntoyinbo gave the order on Tuesday while delivering a judgement in a suit filed by three members of the party, Taiwo Olabode Idris, Kehinde Akala and Alhaji Ayinde Monsuri.<\/p>\n<p>They had dragged the party, Ladi Adebutu and INEC to court to challenge the authenticity of the delegates\u2019 lists used for the conduct of the primaries.<\/p>\n<p>The party had on May 25 conducted the primary election which produced Adebutu as the governorship candidate of the party.<\/p>\n<p>The plaintiffs contended that the persons on delegates\u2019 list used by the electoral panel for the primaries were not democratically elected at the ward, local government and state congresses, hence the panel \u201ccannot unilaterally or arbitrarily impose\u201d the list on the party for the primaries.<\/p>\n<p>The plaintiffs in their originating summons, had prayed the court among others to nullify or set aside the state congress\/indirect primary election, held by the 1st defendant (PDP) on 25th of May, 2022 \u201cfor the purpose of choosing the candidate which the 1st Defendant intends to nominate\/sponsor at the 2023 Governorship election in Ogun State based on the list of delegates who were not democratically elected at the ward congress.\u201d<\/p>\n<p>They also sought an order directing the 2nd Defendant (INEC) \u201cto disregard and\/or refrain from giving effect to the results of the alleged 1st Defendant\u2019s indirect primary election held on the 25th of May, 2022 based on the list of ad-hoc delegates who were not elected at the ward congresses constituted by the 1st Defendant for that purpose\u201d.<\/p>\n<p>Reacting to the judgement, the counsel to the plaintiffs, Thaddeus Idenyi, said the court nullified the election \u201cbecause it was conducted using a list of adhoc delegates who were not elected.\u201d<\/p>\n<p>\u201cThe implication of the judgement is obvious, the PDP will have to put their hats together and then conduct a fresh primary as ordered by the court.<\/p>\n<p>\u201cThis time around, the court was specific that they have to use the list that has been certified by INEC because after the primary, those lists were submitted to INEC as parts of its report of covering those ward congresses held, so the court has now said that is the list which must be considered in the conduct of the fresh primaries, so the PDP had to just put their house together and use those lists to conduct a fresh primary,\u201d he said.<\/p>\n<p>When contacted, the Spokesman of PDP, Akinloye Bankole, said the party would study the judgement before taking any action.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>All the primaries conducted by the Peoples Democratic Party (PDP) ahead of next year\u2019s election have been nullified by a Federal High court in Abeokuta, Ogun State capital.
