{"id":243573,"date":"2023-01-23T04:46:25","date_gmt":"2023-01-23T03:46:25","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=243573"},"modified":"2023-01-23T04:46:25","modified_gmt":"2023-01-23T03:46:25","slug":"lawyers-must-refrain-from-obtaining-orders-seeking-to-shield-corrupt-elites-falana","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/01\/23\/lawyers-must-refrain-from-obtaining-orders-seeking-to-shield-corrupt-elites-falana\/","title":{"rendered":"Lawyers must refrain from obtaining orders seeking to shield corrupt elites \u2013 Falana"},"content":{"rendered":"<p>Femi Falana, a senior advocate of Nigeria (SAN), says lawyers are fond of running to court to seek injunctions to stop the prosecution of influential and wealthy persons accused of corruption. <\/p>\n<p><a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/01\/16\/why-dss-doesnt-need-court-order-to-arrest-emefiele-falana\/\">Falana<\/a> warned that lawyers must desist from securing court orders that protect the elite, especially those accused of corruption.<\/p>\n<p>In an article titled \u2018Courts lack power to stop arrest, investigation and prosecution of criminal suspects\u2019, Falana said the president, vice-president, governors and their deputies are the only officials entitled to immunity from prosecution.<\/p>\n<p>The human rights lawyer lamented that \u201cordinary\u201d citizens who are accused of crimes are locked up and cannot meet the conditions for bail.<\/p>\n<p>\u201cIn view of the foregoing, it is pertinent to caution lawyers to desist from obtaining court orders to confer immunity on members of the ruling class contrary to section 308 of the constitution which provides that only the president, vice-president, governors and deputy governors are immune from arrest and prosecution during their term of office,\u201d he said, while quoting a number of supreme court rulings.<\/p>\n<p>\u201cRich criminal suspects are usually invited by the anti-graft agencies to react to allegations of corruption and other economic crimes leveled against them.<\/p>\n<p>\u201cIn many instances, top lawyers are hired by the highly-placed suspects to rush to either the federal high court or state high court to challenge the legality of the invitation letters. Applications for the enforcement of the fundamental rights of the suspects to personal liberty are filed.<\/p>\n<p>\u201cIn granting the applications, orders of interim, interlocutory and perpetual injunction are made by the courts to restrain the police and anti-graft agencies from arresting, investigating and prosecuting the suspects.<\/p>\n<p>\u201cIn many instances, temporary or permanent immunity has been conferred by public officers or private individuals indicted in criminal diversion of multi million Naira public fund.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Femi Falana, a senior advocate of Nigeria (SAN), says lawyers are fond of running to court to seek injunctions to stop the prosecution of influential and wealthy persons accused of corruption.
