{"id":248327,"date":"2023-02-11T18:36:46","date_gmt":"2023-02-11T17:36:46","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=248327"},"modified":"2023-02-11T18:36:46","modified_gmt":"2023-02-11T17:36:46","slug":"oyetola-apc-ask-court-of-appeal-to-sack-adeleke-over-certificate","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/02\/11\/oyetola-apc-ask-court-of-appeal-to-sack-adeleke-over-certificate\/","title":{"rendered":"Oyetola, APC ask Court of Appeal to sack Adeleke over certificate"},"content":{"rendered":"<p>All Progressives Congress, APC, candidate in the Osun State governorship election, Adegboyega Oyetola has approached the Court of Appeal to further seek the disqualification of Governor Ademola Adeleke.<\/p>\n<p>The Independent National Electoral Commission, <a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/02\/11\/no-excuse-for-failure-4-years-enough-to-prepare-for-elections-can-tells-inec\/\" target=\"_blank\" rel=\"noopener\">INEC<\/a>, had on July 17 announced Adeleke of the Peoples Democratic Party, PDP, as winner of the July 16, 2022 poll.<\/p>\n<p>Former Governor Oyetola and the APC challenged the victory on the grounds that there was over-voting and that Adeleke was not eligible to run at the time.<\/p>\n<p>The Tribunal said though Oyetola and APC proved a case of forgery against the Osun Governor, it was not enough to make him ineligible since he had acquired additional qualifications.<\/p>\n<p>The Tribunal however held that there was indeed over-voting and it deducted the invalid votes from the valid votes and declared Oyetola as winner of that election.<\/p>\n<p>Dissatisfied, INEC, Adeleke and the PDP have appealed the judgement. The governor last week expressed confidence that he\u2019ll defeat his predecessor.<\/p>\n<p>The cross-appeal by Oyetola and the APC is being defended by Lateef Fagbemi, SAN, and Akin Olujimi, SAN.<\/p>\n<p>They argue that the Tribunal misdirected itself when it held that the certificate from Atlanta Metropolitan College and a diploma certificate from Penn Foster High School are genuine.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>All Progressives Congress, APC, candidate in the Osun State governorship election, Adegboyega Oyetola has approached the Court of Appeal to further seek the disqualification of Governor Ademola Adeleke.
