{"id":252648,"date":"2023-03-02T08:43:26","date_gmt":"2023-03-02T07:43:26","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=252648"},"modified":"2023-03-02T08:43:26","modified_gmt":"2023-03-02T07:43:26","slug":"panamas-supreme-court-rules-against-same-sex-marriage","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/03\/02\/panamas-supreme-court-rules-against-same-sex-marriage\/","title":{"rendered":"Panama\u2019s Supreme Court rules against same-sex marriage"},"content":{"rendered":"<p>Panama\u2019s Supreme Court has ruled that same-sex marriage is not a human right and the country therefore does not have to recognise such unions, according to a judgement published Wednesday.<\/p>\n<p>Following several appeals from same-sex couples who claimed the country&#8217;s family code was unconstitutional because it only recognized marriages between a man and a woman, the court began debating the matter in 2016.<\/p>\n<p>\u201cThere is a reality, and it is that, until now, the right to equal marriage is no more than an aspiration, even though a legitimate one for the groups involved, and it does not fall into the category of a human right or a fundamental right,\u201d said the court, in the ruling dated February 16.<\/p>\n<p>The same-sex couples who filed the lawsuit sought to have marriages that occurred in other nations recognized as valid in Panama.<\/p>\n<p>The court, however, said, \u201cno matter how many changes happen in reality,\u201d for now gay marriage \u201clacks conventional and constitutional recognition.\u201d<\/p>\n<p>The court added the family code was \u201cobjectively and reasonably justified in the general interests of giving precedence to those unions capable of <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/03\/15\/pope-orders-catholic-priests-to-desist-from-blessing-same-sex-marriages\/\">establishing families<\/a>, giving continuity to the human species, and therefore, to society.\u201d<\/p>\n<p>The Catholic Church, which opposes same-sex marriage, holds significant political influence in Panama.<\/p>\n<p>The Interamerican Court of Human Rights ruled in 2018 that same-sex couples are entitled to the same marriage rights as opposite-sex couples, in a binding judgement that applied to all of the court\u2019s members, including Panama.<\/p>\n<p>However, Costa Rica remains the only <a href=\"https:\/\/www.withinnigeria.com\/news\/2021\/07\/01\/methodist-church-allows-same-sex-marriages-after-historic-vote\/\">Central American country<\/a> to recognize same-sex marriages.<\/p>\n<p>With the February 16 ruling, the Panamanian justice system \u201chas rejected the recognition of the dignity of same-sex couples and their right to build a family in Panama,\u201d Ivan Chanis, president of the gay rights organisation Fundacion Iguales, told AFP.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Panama\u2019s Supreme Court has ruled that same-sex marriage is not a human right and the country therefore does not have to recognise such unions, according to a judgement published Wednesday.
