{"id":255115,"date":"2023-03-13T13:05:40","date_gmt":"2023-03-13T12:05:40","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=255115"},"modified":"2023-03-13T13:05:40","modified_gmt":"2023-03-13T12:05:40","slug":"breaking-appeal-court-postpones-judgement-on-osun-governorship-appeal","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/03\/13\/breaking-appeal-court-postpones-judgement-on-osun-governorship-appeal\/","title":{"rendered":"BREAKING: Appeal Court postpones judgement on Osun Governorship appeal"},"content":{"rendered":"<p>The Appeal Court, on Monday, postponed judgement on the Osun State Governorship Appeal filed by Governor Ademola Adeleke.<\/p>\n<p>Adeleke had, on February 9th, appealed the judgement of the Osun State Governorship Tribunal, which nullified his election and ruled in favour of the former Governor of the State, Gboyega Oyetola.<\/p>\n<p>Gov Adeleke prayed the court to reject the ruling of the Osun State tribunal describing it as a \u201cmiscarriage of justice\u201d.<\/p>\n<p>However, when the tribunal ruled in favour of a former governor of the state, Gboyega <a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/03\/07\/oyetola-in-iragbiji-vows-to-return-as-osun-governor\/\" target=\"_blank\" rel=\"noopener\">Oyetola<\/a>, two out of the three-member tribunal panel held that Oyetola proved that there was over-voting in some of the polling units.<\/p>\n<p>But weeks later, Adeleke filed an appeal before the Akure division of the Court of Appeal on the 31 grounds of appeal, praying to the court for \u201can order setting aside the whole decision of the tribunal\u201d.<\/p>\n<p>The governor is equally seeking \u201can order striking out the petition for want of competence and jurisdiction or in the alternative, an order dismissing the petition on the merit\u201d.<\/p>\n<p>Adeleke said, \u201cThe second respondent cannot \u2018go lo lo lo lo\u2019 and \u2018buga won\u2019 as the duly elected governor of Osun state.\u201d<\/p>\n<p>\u201cThe tribunal, in its judgment, erred in law and displayed bias against the appellant when it made reference to the appellant\u2019s dance at his inauguration as governor of Osun State, which was never an issue before the lower tribunal,\u201d the governor noted.<\/p>\n<p>\u201cBy referring to the appellant\u2019s personal eccentricity for dancing, the lower tribunal derided and mocked him in a manner suggesting that it was biased against him.\u201d<\/p>\n<p>\u201cThe appearance of bias manifests in reference to the Appellant\u2019s proclivity for dancing, particularly the Buga song, has rendered the decision of the lower Tribunal a nullity.<\/p>\n<p>\u201cThe tribunal in its judgment erred in law in returning the 1st respondent as the duly elected candidate without due regard to the enormity of the voters in the units where the results were cancelled for overvoting.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Appeal Court, on Monday, postponed judgement on the Osun State Governorship Appeal filed by Governor Ademola Adeleke.
