The Lamidi Apapa faction of the Labour Party says calls by the party’s presidential candidate in the February 25 election, Peter Obi, to stop the swearing of President-elect, Bola Tinubu, are illegal. <\/p>\n

The faction said it’s not a party to the calls for an interim government and the agitations for the suspension of be swearing-in of Tinubu on May 29 pending the determination of the petitions before the presidential election tribunal.<\/a><\/p>\n

The Labour Party faction said the swearing in of Tinubu \u201cmay not have any impact on the ongoing legal tussle on the presidential election involving our party, APC and INEC.\u201d<\/p>\n

In a statement on Wednesday, the faction\u2019s spokesman, Abayomi Arabambi, posited that the Electoral Act and the Constitution of Nigeria did not give room for a vacuum, \u201cso whether the President-elect is sworn in or not, there is right to remove him legally if it is found out that he was not duly elected.\u201d<\/p>\n

Arabambi recalled how the court removed Chris Ngige and confirmed Peter Obi as the governor of Anambra in 2003.<\/p>\n

Citing sections 136 and 146 of the constitution, Arabambi said only death and permanent incapacity can stop a President-elect from being sworn in.<\/p>\n

The LP factional spokesman stressed that, \u201cWhat Peter Obi is crying for is not supported by the law.\u201d<\/p>\n

He maintained that \u201ca refusal to swear in Tinubu as President will create a vacuum in the system, saying the law abhors this.<\/p>\n

While stressing that the law does not provide for interim president in this circumstance, Arabambi said \u201ceven Peter Obi once benefitted from the system of being sworn into office despite pending petitions filed against him before the tribunal by Andy Uba.\u201d<\/p>\n

\u201cThe Law has to be complied with, which is to swear in Tinubu as president, and if anybody wants to change the narrative, they will have to change the law,\u201d he stated.<\/p>\n

He spoke further that, \u201cLabour Party warns all Obidiots clandestinely parading themselves as LP members and other Obidients who may be agitating that the President-elect should not be sworn in to have a rethink as Labour Party will not support any unlawful means of agitations or change of government violently.\u201d<\/p>\n
