{"id":268016,"date":"2023-05-11T18:18:48","date_gmt":"2023-05-11T17:18:48","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=268016"},"modified":"2023-05-11T18:18:48","modified_gmt":"2023-05-11T17:18:48","slug":"court-rules-on-fgs-suit-against-asuu-may-30","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/05\/11\/court-rules-on-fgs-suit-against-asuu-may-30\/","title":{"rendered":"Court rules on FG\u2019s suit against ASUU May 30"},"content":{"rendered":"<p>The Academic Staff Union of Universities (ASUU) was sued by the Federal Government, and on Thursday, the National Industrial Court set a decision date of May 30.<\/p>\n<p>The Federal Government took ASUU into court in the lawsuit to decide the substantive claim that was filed during the eight-month strike by ASUU in 2022.<\/p>\n<p>Sen. Ita Enang, the claimants&#8217; attorney, informed the court that the subject was scheduled for the adoption of written addresses when the matter was brought before Justice Benedict Kanyip on Thursday.<\/p>\n<p>However, Mr. Femi Falana SAN, the defendant&#8217;s attorney, disclosed to the court that he has submitted a notice of appeal to the Court of Appeal.<\/p>\n<p><a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/05\/09\/nigerias-economy-destroyed-by-cbns-dollarisation-policy-falana\/\">Falana<\/a> stated that he was contesting the ruling of the court of March 28, which ruled that the Minister of Labour and Employment has the power to refer the matter to the National Industrial Court.<\/p>\n<p>He further prayed for stay of execution and the matter be adjourned pending the outcome of Court of Appeal\u2019s decision.<\/p>\n<p>He also submitted that the issue of competence of the appeal was for Court of Appeal to determine as argued by Enang<\/p>\n<p>Enang urged the court to proceed with the matter of the day which was adoption of written addresses.<\/p>\n<p>The court in its ruling stated that time is of essence in delivery of justice.<\/p>\n<p>\u201d It is better to get a bad judgment quickly than a good judgment in delayed time in labour matters\u201d.<\/p>\n<p>The court also ruled that the authorities cited by the defence counsel was not applicable in the extant case.<\/p>\n<p>The court equally cited Rule 47 of NICN 2006 proceeding and stated that an appeal did not translate to stay of execution.<\/p>\n<p>The judge also said that defence had shown lack of seriousness by not filing its defence and instead opted to file application for stay of execution.<\/p>\n<p>The court in addition said that the matter had been slowed down by various applications.<\/p>\n<p>Kanyip further said \u201cthe application for stay of execution is rejected and the case will proceed and ruling is entered according\u201d.<\/p>\n<p>The court therefore directed the claimant\u2019s counsel to proceed to adopt his written address.<\/p>\n<p>The counsel in respond urged the court to grant all reliefs sought as the suit was not challenged nor contesting by defence through its failure to file processes of defence.<\/p>\n<p>Falana on his part urged the court to consider its record which had his earlier affidavit filed on Sept. 16,2022<\/p>\n<p>He argued that the affidavit which was not challenged encapsulate his defence.<\/p>\n<p>The court therefore adjourned the matter until May 30, for judgment.<\/p>\n<p>News Agency of Nigeria ( NAN) reports that the court adjourned until June 21 a sister case where ASUU is the claimant.<\/p>\n<p>ASUU in the suit is seeking the court to order Minister of Labour and Employment to accept its return of annual financial report<\/p>\n<p>The court had to adjourn as the third defendant\u2019s counsel, Mr Alex Akoja informed the court that he just came into the matter.<\/p>\n<p>Akoja therefore prayed for the adjournment to enable him file processes.<\/p>\n<p>NAN also reports that the third suit involving the parties was also adjourned until June 21, for report of settlement\/ hearing.<\/p>\n<p>The suit where ASUU is also the claimant has the Minister of Labour and Employment and Registrar Trade Unions as defendants.<\/p>\n<p>Earlier, Falana informed the court that he filed a motion for the matter to be transferred to the Alternative Dispute Resolution ( ADR) Centre of the court.<\/p>\n<p>Enang however responded that he was contesting the referral as the claimant had admitted to have failed to file its annual financial returns within the stipulated time.<\/p>\n<p>He also withdrew his preliminary objection application premised on lack of jurisdiction.<\/p>\n<p>The court equally granted Falana the leave to move his application for the court to refer the matter to ADR.<\/p>\n<p>The court having granted the application adjourned the matter until June 21, for report of settlement\/hearing.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Academic Staff Union of Universities (ASUU) was sued by the Federal Government, and on Thursday, the National Industrial Court set a decision date of May 30.
