{"id":271974,"date":"2023-06-03T06:40:05","date_gmt":"2023-06-03T05:40:05","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=271974"},"modified":"2023-06-03T06:40:05","modified_gmt":"2023-06-03T05:40:05","slug":"falana-to-nnpcl-only-president-can-fix-petrol-price","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/06\/03\/falana-to-nnpcl-only-president-can-fix-petrol-price\/","title":{"rendered":"Falana to NNPCL: Only President can fix petrol price"},"content":{"rendered":"<p>Human rights lawyer, Femi Falana has stated that the Nigerian National Petroleum Company Limited (NNPCL) is not legally empowered to fix or adjust the price of petrol.<\/p>\n<p>According to Falana, the<span class=\"acssf62a8\">\u00a0power to fix the price of petrol lies with President Bola Tinubu since there is no substantive minister of petroleum resources.<\/span><\/p>\n<p>Recall that on May 31, NNPCL revealed that it has adjusted the price of petrol across it retail outlets.<\/p>\n<p>The spokesperson of the corporation, Garba Deen Muhammad cited<span class=\"acssf62a8\"> \u201cmarket realities\u201d as the reason for the adjustment of the price.<\/span><\/p>\n<p>It had been reported earlier that filling stations\u00a0<span class=\"acssf62a8\">across the country increased pump prices from N185 to over N500 shortly after President Tinubu declared in his inauguration speech that &#8220;petrol subsidy is gone&#8221;.<\/span><\/p>\n<p><span class=\"acssf62a8\">Reacting to the development in an interview with Channels Television on Friday, Falana said it was against the law that <a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/06\/02\/govt-refinery-to-start-working-december-nnpc\/\">NNPCL<\/a> or the so-called \u201cinvisible market forces\u201d were fixing the price of petrol.<\/span><\/p>\n<p><span class=\"acssf62a8\">\u201cThe NNPC has metamorphosed into a limited liability company. It is now NNPC Limited. To that extent, NNPCs like Total, Exxonmobil, and Shell operating in the oil industry cannot announce increases in the prices of petroleum products. That duty is vested in the government,\u201d the senior advocate of Nigerian (SAN) said.<\/span><\/p>\n<p><span class=\"acssf62a8\">\u201cNobody has the right in Nigeria to fix the prices of <a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/03\/31\/timipre-sylva-resigns-as-minister-of-state-for-petroleum-resources\/\">petroleum<\/a> products other than the government. You have a price control act and at that time the petroleum act, now PIA.<\/span><\/p>\n<p><span class=\"acssf62a8\">\u201cYou ask the NNPC where have you got the power to fix the price of petrol from N185 to N540, how? The invisible market forces cannot under the Nigerian constitution and under the PIA fix the prices of petroleum products.<\/span><\/p>\n<p><span class=\"acssf62a8\">\u201cUnder the current situation in which we have found ourselves since ministers have not been appointed, the president is running the country. Only the president can s\u1ecd decide the price for now. You have the price control act, the PIA.
