The Court of Appeal in the United Kingdom has ruled against the deportation of asylum seekers to Rwanda, describing the move by the government as unlawful. <\/p>\n
Three judges of the appellate court on Thursday averred that the African nation could not be deemed a safe third country. <\/p>\n
Three judges in London said that \u201cunless deficiencies\u201d in Rwanda\u2019s asylum system were addressed, \u201cremoval of asylum seekers to Rwanda will be unlawful.\u201d<\/p>\n
They agreed with migrants and campaigners who brought the case that the UK government could not guarantee that asylum seekers sent to Rwanda would not be deported to the country from which they were fleeing.<\/p>\n
\u201cThe deficiencies in the asylum system in Rwanda are such that there are substantial grounds for believing that there is a real risk that persons sent to Rwanda will be returned to their home countries, where they faced persecution or other inhumane treatment,\u201d said the judges.<\/p>\n
A majority of judges were not convinced by Rwanda\u2019s assurances, saying that, although made in good faith, the proof they presented \u201cdoes not ascertain that the required changes had by then been reliably effected or would have been at the time of the proposed removals.<\/p>\n
\u201cIn consequence, sending anyone to Rwanda would constitute a breach of article 3 of the European Convention on Human Rights\u201d which states that no one shall be subjected to torture, inhuman or degrading treatment or punishment, they added.<\/p>\n
The Rwandan government told AFP that it remained committed to the plan. <\/p>\n
It stated that while it can’t go against the ruling of the court, the description of Rwanda as unsafe did not sit well with the government of Rwanda. <\/p>\n
\u201cWhile this is ultimately a decision for the UK\u2019s judicial system, we do take issue with the ruling that Rwanda is not a safe country for asylum seekers and refugees,\u201d said government spokeswoman Yolande Makolo.<\/p>\n
Makolo insisted that Rwanda was \u201cone of the safest countries in the world\u201d and said, \u201cwe have been recognised by the UNHCR and other international institutions for our exemplary treatment of refugees\u201d.<\/p>\n","protected":false},"excerpt":{"rendered":"
