{"id":290069,"date":"2023-09-22T08:24:35","date_gmt":"2023-09-22T07:24:35","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=290069"},"modified":"2023-09-22T08:24:35","modified_gmt":"2023-09-22T07:24:35","slug":"enugu-labour-party-fumes-as-tribunal-upholds-mbahs-election-as-governor","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/09\/22\/enugu-labour-party-fumes-as-tribunal-upholds-mbahs-election-as-governor\/","title":{"rendered":"Enugu: Labour Party Fumes As Tribunal Upholds Mbah&#8217;s Election As Governor"},"content":{"rendered":"<ul>\n<li><strong>Mbah applauded the Tribunal\u2019s verdict, describing it as a victory for democracy and Enugu State<\/strong><\/li>\n<li><b>The deduction reduced Mbah\u2019s votes to 160, 567 from 160, 844, while Edeoga\u2019s votes were reduced to 157, 555<\/b><\/li>\n<\/ul>\n<hr \/>\n<p>The ruling of the election petition tribunal, which dismissed their applications for lack of merit, has been contested by the Labour Party and its candidate for the March 18 governorship election in Enugu State.<\/p>\n<p>The case submitted by the LP and its candidate, Chijioke Edoga, to contest the win of Governor Peter Mbah of the Peoples Democratic Party in the state&#8217;s March 18 governorship election was dismissed by the Enugu State Governorship Election Petitions Tribunal on Thursday.<\/p>\n<p>The three-member tribunal unanimously dismissed all of the petition&#8217;s reasons in a judgement read by Justice Kudirat Akano, the tribunal&#8217;s chairman, and declaring the LP&#8217;s complaint against Mbah incompetent and without merit.<\/p>\n<p>One of the major grounds of the LP\u2019s petition was the allegation that Mbah forged his National Youth Service Corps discharge certificate. But the tribunal resolved the issue in Mbah\u2019s favour.<\/p>\n<p>\u201cThe NYSC certificate is not a qualification for anyone who wants to run for the office of the governor of the state as enshrined under Section 177 of the 1999 constitution. The academic qualifications required of any governorship candidate, as captured under Section 177 (d), is a school certificate, which has been interpreted under Section 318 of the 1999 Constitution of the Federal Republic of Nigeria.<\/p>\n<p>\u201cThe NYSC discharge certificate is not a qualification as captured under the aforementioned section of the constitution and, therefore, cannot disqualify any person who has met the constitutional requirements and has been duly elected into the office of the governor of a state,\u201d the tribunal held.<\/p>\n<p>The tribunal also dismissed the LP\u2019s contention that Mbah did not win a majority of valid votes at the poll.<\/p>\n<p>The tribunal, however, agreed that the petitioners proved their allegation of over-voting at some polling units in Amagu Ugbawka, Nkanu East Local Government Area. The tribunal, therefore, cancelled the votes and deducted them from the votes of both parties.<\/p>\n<p>The deduction reduced Mbah\u2019s votes to 160, 567 from 160, 844, while Edeoga\u2019s votes were reduced to 157, 555.<\/p>\n<p>The tribunal said having resolved the issue in favour of the respondents, the \u201cpetition of the petitioners\u2019 is hereby struck for lacking in merit.\u201d<\/p>\n<p>But the LP and its candidate, Edeoga, rejected the tribunal verdict, vowing to test it on appeal.<\/p>\n<p>\u201cWe wish to convey the acknowledgment by the Labour Party and its candidate, Chijioke Edeoga, of the judgment as delivered at the tribunal, and to state our preparedness to challenge the outcome of this judgment at the Court of Appeal and to all extents as permitted by law,\u201d Edeoga\u2019s spokesman, George Ugwu, said in a statement.<\/p>\n<p>However, <a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/09\/21\/just-in-enugu-tribunal-upholds-gov-mbahs-election-dismisses-lps-petition\/\">Mbah<\/a> applauded the Tribunal\u2019s verdict, describing it as a victory for democracy and Enugu State.<\/p>\n<p>He extended a hand of fellowship to the opposition candidates and their political parties, saying collective efforts were needed to build Enugu
