{"id":290687,"date":"2023-09-26T12:45:00","date_gmt":"2023-09-26T11:45:00","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=290687"},"modified":"2023-09-26T12:45:00","modified_gmt":"2023-09-26T11:45:00","slug":"court-stops-impeachment-of-ondo-deputy-governor","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/09\/26\/court-stops-impeachment-of-ondo-deputy-governor\/","title":{"rendered":"Court stops impeachment of Ondo deputy governor"},"content":{"rendered":"<ul>\n<li><strong>Judge made an order of interim injunction restraining Akeredolu, his servants or privies from harassing, intimidating, embarrassing and preventing Aiyedatiwa in carrying out the functions of his office as deputy governor of Ondo State<\/strong><\/li>\n<li><strong>Adjourned the matter until Oct. 9 for hearing<\/strong><\/li>\n<\/ul>\n<p>A Federal High Court, Abuja, on Tuesday, restrained the Ondo State House of Assembly from impeaching the Deputy Governor, Mr Lucky Aiyedatiwa, over alleged gross misconduct.<\/p>\n<p>Justice Emeka Nwite, in a ruling shortly after Aiyedatiwa\u2019s counsel, Kayode Adewusi, moved the ex-parte motion to the effect.<\/p>\n<p>The judge also restrained Gov. Rotimi Akeredolu from nominating a new deputy governor and forward same to the lawmakers for approval pending the hearing and determination of the substantive matter.<\/p>\n<p>Justice Nwite held that after listening to Adewusi, he was of the view that the interest of justice would be met by granting the application.<\/p>\n<p>\u201cTherefore, the application of the applicant succeeds,\u201d he said.<br \/>\nThe News Agency of Nigeria (NAN) reports that the embattled deputy governor had, in a motion on notice marked: FHC\/ABJ\/CS\/1294\/2023, sued the Inspector-General (I-G) of Police and the the Department of State Services (DSS).<\/p>\n<p>Others are Gov. Akeredolu, Speaker of the House of Assembly, Chief Judge of Ondo State and the House of Assembly as 1st to 6th respondents respectively.<\/p>\n<p>In the application dated and filed by Mr Adelanke Akinrata on Sept. 21, <a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/09\/20\/breaking-ondo-assembly-moves-to-impeach-akeredolus-deputy-aiyedatiwa\/\" target=\"_blank\" rel=\"noopener\">Aiyedatiwa<\/a> sought for four reliefs.<br \/>\nThe judge further made an order of interim injunction restraining Akeredolu, his servants or privies from harassing, intimidating, embarrassing and preventing Aiyedatiwa in carrying out the functions of his office as deputy governor of Ondo State.<\/p>\n<p>Justice Nwite, who granted all the reliefs adjourned the matter until Oct. 9 for hearing.<\/p>\n<p>NAN reports that Aiyedatiwa had, also in another suit marked: AK\/348\/2023 prayed the High Court in Akure to stop the state\u2019s house of assembly from proceeding with the
