{"id":292795,"date":"2023-10-10T10:19:18","date_gmt":"2023-10-10T09:19:18","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=292795"},"modified":"2023-10-10T10:19:18","modified_gmt":"2023-10-10T09:19:18","slug":"apc-reacts-as-court-sacks-bayelsa-governorship-candidate","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/10\/10\/apc-reacts-as-court-sacks-bayelsa-governorship-candidate\/","title":{"rendered":"APC Reacts As Court Sacks Bayelsa Governorship Candidate"},"content":{"rendered":"<ul>\n<li><strong>The party has requested its lawyers to appeal the Federal High Court&#8217;s judgment, with confidence that the Court of Appeal will overturn the decision.<\/strong><\/li>\n<li><b>Mr Perry Tukuwei, the Director, Media and Publicity APC Bayelsa Gubernatorial Campaign Council, said this in a statement on Tuesday in Yenagoa.<\/b><\/li>\n<\/ul>\n<hr \/>\n<p>The All Progressives Congress (APC) has stated that it intends to contest Chief Timipre Sylva&#8217;s disqualification from the November 11 election as its candidate for governor of Bayelsa.<\/p>\n<p><a href=\"http:\/\/withinnigeria.com\"><strong>WITHIN NIGERIA<\/strong><\/a> had earlier reported that in a ruling handed down on Monday, Justice Donatus Okorowo of the Federal High Court in Abuja had declared Sylva ineligible to run for governor.<\/p>\n<p>Okorowo concluded that Sylva would violate the 1999 constitution as amended if she were permitted to run for office again after being twice sworn in and serving as the <a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/10\/10\/just-in-court-disqualifies-apc-governorship-candidate-in-bayelsa\/\">governor of Bayelsa for five years.<\/a><\/p>\n<p>This was said in a statement made on Tuesday in Yenagoa by Mr. Perry Tukuwei, the Director of Media and Publicity for the APC Bayelsa Gubernatorial Campaign Council.<\/p>\n<p>\u201cThe party has briefed its lawyers to appeal the judgement, and it is confident that the Court of Appeal will overturn the judgement of the Federal High Court.<\/p>\n<p>\u201cThis reassurance is in reaction to a judgement which has the Peoples Democratic Party and its candidate written all over it by a Federal High Court in Abuja in an already failed bid to dash the hopes of Bayelsa people, to have their preferred candidate, Chief Timipre Sylva, as the next helmsman at Creek Haven by Feb. 14, 2024.<\/p>\n<p>\u201cSections 29 and 84 of the 2022 Electoral Act state that only persons who contested primaries of a political party that has the locus standi to file a pre-election matter to challenge the qualification of the party\u2019s candidate in any election hence the suit filed by one Chief Demesuoyefa Kolomo who is not a member of the APC and didn\u2019t contest our party\u2019s governorship primaries do not have the locus standi to sue in the matter.<\/p>\n<p>\u201cSection 285 of the 1999 Nigerian constitution enjoins any aggrieved party to file election matter within 14 days of the occurrence of the event, but this case was filed on the 13th of June 2023 whereas INEC published the names of the governorship candidates for Bayelsa, Imo and Kogi on May 12,\u2019\u2019 Tukuwei said.<\/p>\n<p>He added: \u2019\u2019Thus, the case was filed outside the constitutional prescribed 14 days, thereby making the case statute barred.<\/p>\n<p>\u201cIt is surprising to the party and Bayelsa people that the court ignored the fact that the plaintiff lacked the locus standi to sue and went ahead to give judgement in their favour.\u201d<\/p>\n<p>He said the suit was contrary to a directive by the Supreme Court that all pre-election matters be heard in the state where party primaries were held.<\/p>\n<p>\u201cTo perfect their sinister act, the case was filed in Abuja. Is Abuja Bayelsa?<\/p>\n<p>\u201cSubsequently, the Bayelsa APC can smell the coffee and sinister move by Gov. Douye Diri to go through the back door, which is his usual practice having realised that our governorship candidate is coasting home to victory already following unrivalled acceptance across the state.<\/p>\n<p>\u201cOur dear people of Bayelsa, fear not!
