{"id":294353,"date":"2023-10-23T11:44:03","date_gmt":"2023-10-23T10:44:03","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=294353"},"modified":"2023-10-23T11:44:03","modified_gmt":"2023-10-23T10:44:03","slug":"just-in-after-scolding-from-supreme-court-apm-withdraws-appeal-against-tinubu","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/10\/23\/just-in-after-scolding-from-supreme-court-apm-withdraws-appeal-against-tinubu\/","title":{"rendered":"JUST-IN: After Scolding From Supreme court, APM Withdraws Appeal Against Tinubu"},"content":{"rendered":"<ul>\n<li><strong>Following the position of the panel on the matter, Mr. Machukwu Ume, SAN, withdrew the appeal and it was accordingly struck out.\u00a0<\/strong><\/li>\n<li><b>The party had in its 10-ground of appeal, maintained its position that Tinubu was not eligible to participate in the presidential poll that held on February 25.<\/b><\/li>\n<\/ul>\n<hr \/>\n<p>The Supreme Court challenge that the Allied Peoples Movement, APM, had filed to overturn President Bola Tinubu&#8217;s election victory has been withdrawn.<\/p>\n<p>Shortly after the matter was brought for hearing, the party, represented by Mr. Chukwuma Machukwu Ume, SAN, withdrew it.<\/p>\n<p>The party was chastised by a seven-person apex court bench, chaired by Justice Inyang Okoro, for bringing an appeal that they claimed was without merit.<\/p>\n<p>The panel asked what the <a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/10\/06\/illegal-nomination-apm-asks-supreme-court-to-void-tinubus-election\/\">APM<\/a> stood to gain by the appeal, citing this as one of the factors contributing to the overburden on the supreme court.<\/p>\n<p>It said the appeal would amount to a total waste of time and an academic exercise since the party only wanted the apex court to \u201cstate the law.\u201d<\/p>\n<p>\u201cIf we are idle, then maybe we will state the law. If there is nothing for you to gain from an appeal, you don\u2019t just come to court for interpretation.<\/p>\n<p>\u201cIf for instance that you win a case, there must be something to be gained from the victory. We have read your appeal, there is absolutely nothing in it. You are not asking for your candidate to declared winner or anything of such, all you want is for the President to be removed.<\/p>\n<p>\u201cIf we remove the President, then what next? There are two other appeals here that are asking for something substantial,\u201d Jutice Okoro fumed.<\/p>\n<p>Earlier, a member of the panel, Justice Emmanuel Agim, noted that issues the APM raised in its appeal, was previously decided by the Supreme Court.<\/p>\n<p>\u201cWe are not bound to hear every appeal. What you are asking us is to overrule ourselves. Did you not read our decision on the issue of double nomination,\u201d Justice Agim queried APM\u2019s lawyer.<\/p>\n<p>Following the position of the panel on the matter, Mr. Machukwu Ume, SAN, withdrew the appeal and it was accordingly struck out.<\/p>\n<p>The party had in its 10-ground of appeal, maintained its position that Tinubu was not eligible to participate in the presidential poll that held on February 25.<\/p>\n<p>It argued that Tinubu\u2019s running mate and Vice President, Kashim Shettima, was nominated twice for different positions by the All Progressives Congress, APC, in relation to the 2023 general elections.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Following the position of the panel on the matter, Mr. Machukwu Ume, SAN, withdrew the appeal and it was accordingly struck out.\u00a0 The party had in its 10-ground of appeal, maintained its position that Tinubu was not eligible to participate in the presidential poll that held on February 25.
