{"id":294482,"date":"2023-10-24T16:05:16","date_gmt":"2023-10-24T15:05:16","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=294482"},"modified":"2023-10-24T16:05:16","modified_gmt":"2023-10-24T15:05:16","slug":"court-orders-pdp-to-replace-anyanwu-as-national-secretary","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/10\/24\/court-orders-pdp-to-replace-anyanwu-as-national-secretary\/","title":{"rendered":"Court Orders PDP To Replace Anyanwu As National Secretary"},"content":{"rendered":"<ul>\n<li><strong>Ugwu is seeking the court to declare Senator Anyanwu&#8217;s seat vacant due to his current position as the party candidate in the upcoming Imo state governorship election.<\/strong><\/li>\n<li><strong>Justice C.O Ajah ruled that the motion on notice was filed under High Court rules of Enugu State 2020, supported by 23-paragraph affidavits from the applicant.<\/strong><\/li>\n<\/ul>\n<hr \/>\n<p>The Peoples Democratic Party (PDP) has been directed by an Enugu State High Court to substitute Senator Samuel Anyanwu as the party&#8217;s National Secretary.<\/p>\n<p>In addition, Anyanwu is the PDP&#8217;s nominee for governor of Imo State in the upcoming election.<\/p>\n<p>After Nwabueze Ugwu filed a motion on notice, the order was granted.<\/p>\n<p>Ugwu was asking the court to declare Senator Anyanwu&#8217;s seat empty because he is currently the party&#8217;s nominee for governor of Imo state, which is scheduled for next month.<\/p>\n<p>While ruling on the motion on notice, the court compelled the defendants in the suit- the <a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/10\/20\/pdp-was-given-uppercut-in-presidential-election-says-bode-george\/\">PDP national chairman, the PDP national secretary,<\/a> and the national vice chairman, south-east to recognise Sunday Udeh-Okoye as the candidate recommended by the South-East Zonal Executive Committee to replace Anyanwu pending the determination of the motion on notice.<\/p>\n<p>The presiding judge, Justice C.O Ajah held that the motion on notice was brought under order 38 rule 1, order 39 rule 1 of High Court rules of Enugu State 2020, supported by 23-paragraph affidavits deposed to by the applicant.<\/p>\n<p>Justice Ajah ordered as follows: \u201cThat an Interim Order is hereby granted as prayed.<\/p>\n<p>\u201cThat the 2 Defendant\/Respondent is hereby ordered to recognize within 24 hours of the service of this order on him, HON. S.K.E. UDEH-OKOYE (the person recommended by the South East Zonal Executive Committee of the 1\u201d Defendant \/Respondent; pending the hearing and determination of the Motion on Notice.<\/p>\n<p>\u201cThat this Order will lapse after seven (7) days from today in accordance with the Rules of this Court. That the matter is adjourned to 30\/10\/2023 for the hearing of the Motion on Notice.\u201d<\/p>\n<p>The PDP, southeast zone, last weekend, unanimously nominated the former PDP National Youth Leader, Hon.
