{"id":296096,"date":"2023-11-06T16:02:22","date_gmt":"2023-11-06T15:02:22","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=296096"},"modified":"2023-11-06T16:02:22","modified_gmt":"2023-11-06T15:02:22","slug":"just-in-efcc-fails-to-produce-ex-cbn-gov-emefiele-in-court","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/11\/06\/just-in-efcc-fails-to-produce-ex-cbn-gov-emefiele-in-court\/","title":{"rendered":"JUST-IN: EFCC Fails To Produce Ex-CBN Gov, Emefiele In Court"},"content":{"rendered":"<ul>\n<li><strong>Emefiele, who has been detained since June 9, has filed a complaint with the court to enforce his fundamental human rights.<\/strong><\/li>\n<li><strong>The individual is requesting immediate release from EFCC custody and is also requesting a N5 million damages award from the court<\/strong><\/li>\n<\/ul>\n<hr \/>\n<p>The troubled former governor of the Central Bank of Nigeria, Godwin Emefiele, was not produced by the Economic and Financial Crimes Commission (EFCC) on Monday as required by the Federal Capital Territory&#8217;s sitting High Court in Maitama.<\/p>\n<p>On November 2, Justice Olukayode Adeniyi issued an order to the anti-graft agency directing them to either unconditionally release Emefiele or bring him before the court to be granted bail.<\/p>\n<p>However, Emefiele&#8217;s attorney, Mr. Mathew Burkaa, informed the court at the matter&#8217;s reopened procedure that the <a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/11\/02\/bail-condition-well-no-longer-demand-professional-certificates-of-sureties-efcc\/\">EFCC<\/a> had disregarded the directive.<\/p>\n<p>\u201cMy lord they have flouted both orders as today marks the 149th day of the Applicant being in custody.<\/p>\n<p>\u201cThe Applicant is still in custody of the 3rd and 4th Respondents, up till this moment that we speak,\u201d Emefiele\u2019s lawyer added.<\/p>\n<p>On his part, the lawyer that represented the EFCC, Mr Farouk Abdullahi, while confirming that the order was served on the Commission, said it was not true that Emefiele has been in the custody of the agency for over 100 days.<\/p>\n<p>\u201cMy lord, I do confirm that we received the order. It is however not correct that the Applicant has been in custody of the 3rd and 4th Respondent for over 100 days.<\/p>\n<p>\u201cHe has only been in custody of 3rd and 4th for only 7 days<\/p>\n<p>\u201cWe got the processes and we intend to react to them to set the record straight.<\/p>\n<p>\u201cUnfortunately, we are unable to do so because the processes received by 3rd and 4th respondents were incomplete.<\/p>\n<p>\u201cWe are not insinuating that it was deliberate, it may be inadvertent on the part of counsel for the Applicant.<\/p>\n<p>\u201cCertain exhibits they referred to, particularly exhibit E, were not attached.\u201d<\/p>\n<p>Queried by the judge if the absence of the exhibit was sufficient reason for EFCC to disobey the order of the court, Farouk, said they misunderstood the order.<\/p>\n<p>\u201cMy lord, we thought that the order was that we either release him unconditionally or bring him to the court so that his bail application will be heard.<\/p>\n<p>\u201cMy lord, the 3rd Respondent is a law-abiding establishment that will never take orders of this court for granted,\u201d the EFCC lawyer pleaded.<\/p>\n<p>Meanwhile, before he adjourned the matter till November 8, Justice Adeniyi reinstated the orders of the court.<\/p>\n<p>He ordered the EFCC to either release Emefiele unconditionally or in the alternative, produce him in court on the next adjourned date to be admitted to bail.<\/p>\n<p>Emefiele, who has been in detention since June 9, approached the court to enforce his fundamental human rights.<\/p>\n<p>Aside from seeking his immediate release from EFCC custody, he is praying the court to award him damages to the tune of N5 million.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Emefiele, who has been detained since June 9, has filed a complaint with the court to enforce his fundamental human rights.
