{"id":297523,"date":"2023-11-17T12:27:14","date_gmt":"2023-11-17T11:27:14","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=297523"},"modified":"2023-11-17T12:27:14","modified_gmt":"2023-11-17T11:27:14","slug":"just-in-appeal-court-sacks-governor-abba-kabir-yusuf-of-kano-state","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/11\/17\/just-in-appeal-court-sacks-governor-abba-kabir-yusuf-of-kano-state\/","title":{"rendered":"JUST-IN: Appeal Court Sacks Governor Abba Kabir Yusuf Of Kano State"},"content":{"rendered":"<ul>\n<li><strong>At the court, Wole Olanipekun, SAN, lead for Yusuf, asked that the judgement of the tribunal be set aside.<\/strong><\/li>\n<li><b>Akin Olujimi SAN, counsel for APC, countered him saying the Appeal Court stated emphatically that the non-signing of ballots amounted to electoral malpractice.<\/b><\/li>\n<\/ul>\n<hr \/>\n<p>Governor Abba Kabir Yusuf of Kano State has been fired by the Court of Appeal, which is located in Abuja.<\/p>\n<p>The panel maintained the decision of the tribunal that dismissed Yusuf on September 20, 2023, under the direction of Justice Oluyemi Akintan Osadebay.<\/p>\n<p>Because Yusuf&#8217;s 165,663 votes were not signed or stamped by the <a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/11\/15\/bayelsa-election-inec-and-security-agents-praised-for-professionalism-by-observers\/\">Independent National Electoral Commission (INEC)<\/a>, the lower court ruled that his votes, which he had submitted as a candidate for the New Nigerian Peoples Party (NNPP), were illegal.<\/p>\n<p>Subsequently, the governor&#8217;s votes dropped to 853,939, while Nasir Ganuwa, his All Progressives Congress (APC) opponent, maintained 890,705 votes.<\/p>\n<p>Yusuf had rejected the tribunal verdict, which he described as \u201cunfair\u201d and \u201ca miscarriage of justice\u201d, and headed to the appeal court.<\/p>\n<p>At the court, Wole Olanipekun, SAN, lead for Yusuf, asked that the judgement of the tribunal be set aside.<\/p>\n<p>Kicking against the ruling on ballot papers, the senior lawyer said that was the first time in the history that a tribunal would annul an election over non-signing of the back of ballot papers.<\/p>\n<p>He had said the tribunal erred, arguing further that, that was the first time that a political party would file a matter without joining its candidate as a party in the petition and the candidate would declared winner of the polls.<\/p>\n<p>But Akin Olujimi SAN, counsel for APC, countered him saying the Appeal Court stated emphatically that the non-signing of ballots amounted to electoral malpractice.<\/p>\n<p>Details later\u2026<\/p>\n","protected":false},"excerpt":{"rendered":"<p>At the court, Wole Olanipekun, SAN, lead for Yusuf, asked that the judgement of the tribunal be set aside.
