{"id":301370,"date":"2023-12-17T13:47:25","date_gmt":"2023-12-17T12:47:25","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=301370"},"modified":"2023-12-17T13:47:25","modified_gmt":"2023-12-17T12:47:25","slug":"legislation-against-unexplained-wealth-panacea-to-looting-of-public-treasury-efcc","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2023\/12\/17\/legislation-against-unexplained-wealth-panacea-to-looting-of-public-treasury-efcc\/","title":{"rendered":"Legislation against unexplained wealth panacea to looting of public treasury \u2013 EFCC"},"content":{"rendered":"<ul>\n<li><strong>Olukoyede disclosed that several countries, including the United Kingdom, Australia, Mauritius, Kenya, Zimbabwe and Trinidad and Tobago, had embraced the Unexplained Wealth Orders, UWOs, since it came into force in 2018<\/strong><\/li>\n<\/ul>\n<hr \/>\n<p>The Chairman of <a href=\"https:\/\/www.withinnigeria.com\/news\/2023\/12\/13\/efcc-seeks-speedy-recovery-of-stolen-nigerian-assets-abroad\/\">the Economic and Financial Crimes Commission (EFCC),<\/a> Mr Ola Olukoyede, says lack of laws against acquisition of unexplained wealth is hampering tackling of corruption in the public and private sector.<\/p>\n<p>The foremost anti-graft agency in the country is seeking legislation against unexplained wealth to nip the criminal activities of treasury looters in the country in its bud.<\/p>\n<p>EFCC Spokesperson, Mr Dele Oyewale, in a statement, quoted Olukoyede as making the call at a two-day International Law Conference organised by Christopher University, Mowe, Ogun State.<\/p>\n<p>The theme of the conference is \u201cUnexplained Wealth in the Global South: Examining the Asset Recovery and Return Trajectory\u201d.<\/p>\n<p>Olukoyede disclosed that several countries, including the United Kingdom, Australia, Mauritius, Kenya, Zimbabwe and Trinidad and Tobago, had embraced the Unexplained Wealth Orders, UWOs, since it came into force in 2018.<\/p>\n<p>He said the EFCC was still relying on the provisions of Section 7 of its Establishment Act to check the menace.<\/p>\n<p>\u201cThe issue of unexplained wealth is not a local issue. There are jurisdictional legislations across the world to tackle it.<\/p>\n<p>\u201cTo date, countries of the world are faced with criminalities emanating from money laundering practices and illicit funds. This circumstance led to the promulgation of Unexplained Wealth Orders, UWOs, that came into force in 2018.<\/p>\n<p>\u201cSeveral countries, such as the United Kingdom, Australia, Mauritius and African countries like Kenya, Zimbabwe, and Trinidad and Tobago in the Caribbean have come up with UWO. Nigeria is yet to come up with a national legislation on it,\u201d he said.<\/p>\n<p>The EFCC boss, who was represented at the conference by the Abuja Zonal Commander, Assistant Commander of the EFCC, ACE1 Adebayo Adeniyi, emphasised that treasury looters would have little cover if the issue of unexplained wealth was tackled more seriously across the world.<\/p>\n<p>\u201cIn Nigeria today, unexplained wealth has become a practical means of tracing, identifying, investigating and prosecuting corruption cases.<\/p>\n<p>\u201cAs an anti-graft agency, suspects of any economic and financial crimes are usually required to declare their assets in the course of an investigation.<\/p>\n<p>\u201cThe basis for this is to properly establish their true asset base and their linkage or otherwise to any act of corruption.<\/p>\n<p>\u201cOwing to the absence of legislation on the issue of unexplained wealth, the EFCC continues to rely on provisions of Section 7 of its Establishment Act to handle it,\u201d he said.<\/p>\n<p>Olukoyede said the concerns about unexplained wealth bordered more on asset tracing, investigation and recovery.<\/p>\n<p>\u201cNations are rapidly settling for non-conviction-based asset forfeiture. The reason for this is simple because unexplained wealth can only be beneficial to the state if they are forfeited.<\/p>\n<p>\u201cSince inception, the EFCC has secured sizable assets from fraudsters. They range from houses, vehicles, barges, jewellery, money, furniture items, landed properties, among others,\u201d he said<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Olukoyede disclosed
