{"id":305257,"date":"2024-01-11T15:02:30","date_gmt":"2024-01-11T14:02:30","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=305257"},"modified":"2024-01-11T15:07:19","modified_gmt":"2024-01-11T14:07:19","slug":"mambilla-court-grants-ex-minister-agunloye-n50m-bail","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2024\/01\/11\/mambilla-court-grants-ex-minister-agunloye-n50m-bail\/","title":{"rendered":"Mambilla: Court Grants Ex-Minister Agunloye N50m Bail"},"content":{"rendered":"<ul>\n<li><strong>The Counsel for the former minister, Adeola Adedipe, ask the trial court to grant bail to his client by way of self-recognisance<\/strong><\/li>\n<\/ul>\n<hr \/>\n<p>The Federal Capital Territory (FCT) High Court Apo has granted bail to embattled ex-Minister of Power and Steel, Olu <a href=\"https:\/\/www.withinnigeria.com\/news\/2024\/01\/10\/fraud-court-remands-ex-minister-of-power-agunloye-in-kuje-prison\/\">Agunloye<\/a>, in the sum of N50 million.<\/p>\n<p>Agunloye is standing trial over the alleged fraud and corruption that characterised the award of the mambilla power project.<\/p>\n<p>He was arraigned by the Economic and Financial Crimes Commission (EFCC) on seven counts bordering on fraudulent award of a contract and official corruption, on Wednesday.<\/p>\n<p>The judge had ordered his remand in Kuje Correctional Centre pending hearing and ruling on the bail application.<\/p>\n<p>However, the Counsel for the former minister, Adeola Adedipe, ask the trial court to grant bail to his client by way of self-recognisance or in liberal terms.<\/p>\n<p>He said Argunloye is not a flight risk and that the notion canvassed by the prosecution was \u201cborn out of misconception and communication barrier\u201d.<\/p>\n<p>Adedipe also prayed the court not to order the use of a public servant as surety for his client.<\/p>\n<p>The senior lawyer also argued that the apprehensive misconception about bail and the mischief argued by the prosecution has been cured by Section 352( 4) of the Administration of Criminal Justice Act (ACJA).<\/p>\n<p>Under this provision, Adeola said, \u201cOnce a defendant is admitted to bail, even if he absconds, the trial will continue and he will be convicted where necessary.\u201d<\/p>\n<p>However, the prosecution counsel opposed the bail application.<\/p>\n<p>Delivering the ruling, Justice Jude Onwuegbuzie said the court favoured granting bail to the defendant.<\/p>\n<p>He granted N50 million bail to the defendant and ordered him to produce two sureties in like sum.<\/p>\n<p>The sureties must be \u201creputable\u201d and \u201cpeople of means\u201d resident within the FCT.<\/p>\n<p>They must have properties worth N300 million with a Certificate of Occupancy that must be verifiable.<\/p>\n<p>They must submit copies of their identity card and photocopies of their international passports to the court.<\/p>\n<p>The defendant is to submit his passport to the court and must be present for hearing at all times.<\/p>\n<p>The matter has been adjourned to February 12.<\/p>\n<p>The Economic and Financial Crimes Commission (EFCC) is investigating Agunloye over the $6 billion Mambilla Hydropower Contract<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Counsel for the former minister, Adeola Adedipe, ask the trial court to grant bail to his client by way of self-recognisance The Federal Capital Territory (FCT) High Court Apo has granted bail to embattled ex-Minister of Power and Steel, Olu Agunloye, in the sum of N50 million.
