{"id":308362,"date":"2024-02-01T06:40:42","date_gmt":"2024-02-01T05:40:42","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=308362"},"modified":"2024-02-01T06:40:42","modified_gmt":"2024-02-01T05:40:42","slug":"lagos-man-sentenced-to-life-imprisonment-for-raping-infecting-14-year-old-with-hiv","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2024\/02\/01\/lagos-man-sentenced-to-life-imprisonment-for-raping-infecting-14-year-old-with-hiv\/","title":{"rendered":"Lagos man sentenced to life imprisonment for raping, Infecting 14-year-old with HIV"},"content":{"rendered":"<ul>\n<li><strong>He was convicted and sentenced by Justice Oyindamola Ogala of the Lagos High Court, Ikeja, on Tuesday.<\/strong><\/li>\n<\/ul>\n<hr \/>\n<p>One Richard Saviour has been sentenced to life imprisonment for defiling and infecting a 14-year-old with Human Immunodeficiency Virus.<\/p>\n<p>The victim is a niece to the convict&#8217;s wife.<\/p>\n<p>He was convicted and sentenced by Justice Oyindamola Ogala of the Lagos High Court, Ikeja, on Tuesday.<\/p>\n<p>The development is contained in a statement issued by the <a href=\"https:\/\/www.withinnigeria.com\/news\/2024\/01\/31\/just-in-no-going-back-on-faan-relocation-to-lagos-keyamo\/\">Lagos state<\/a> Domestic and Sexual Violence agency.<\/p>\n<p>\u201cThe judge said when the police took the victim to the Mirabel Centre, she was tested and found to be HIV positive.<\/p>\n<p>&#8220;Thereafter, she was transferred to Mary\u2019s Home Orphanage and looked after with the help of Positive Action for Treatment Access, a Non-Governmental Organisation.<\/p>\n<p>\u201cThe judge, hence, convicted the defendant on the charge of defilement by unlawful sexual assault and sentenced him to life imprisonment in the correctional centre,\u201d the statement published Wednesday on the agency\u2019s X handle, @Lagosdsva, read.<\/p>\n<p>The agency noted that the State Counsel, Ola Azeez, called three witnesses to prove the prosecution\u2019s case while the convict testified in his defence during the trial.<\/p>\n<p>In her ruling, the judge held that the evidence provided by all the prosecution witnesses was substantiated and considered as the truth.<\/p>\n<p>Justice Ogala said the victim\u2019s evidence was corroborated by the Investigating Police Officer and Social Worker from the state Ministry of Youth and Social Welfare.<\/p>\n<p>According to her, these established the offence of defilement against the convict.<\/p>\n<p>The judge said, \u201cThe testimony before the court depicts the \u2018evil\u2019 perpetrated on this young girl and how she was abused both mentally and physically by the defendant and his wife for years.<\/p>\n<p>\u201cRevealing how she indeed \u2018cried out\u2019 for help and was betrayed by those who were supposed to help and support her.<\/p>\n<p>\u201cIt is imperative to state at this juncture that the actions of the principal of PW2\u2019s school and the social worker (PW3) are commendable as same eventually brought some succour and relief to PW2, who unfortunately has been permanently \u2018scared\u2019<\/p>\n<p>\u201cHaving carefully considered the entirety of facts before the court, it finds that in this instance, the prosecution has satisfactorily proved the one count information the defendant stands faced with.\u201d<\/p>\n<p>Ogala said the mien of the defendant was desperate to distance himself from the allegation by denying the offences.<\/p>\n<p>\u201cThe defendant in his evidence before the court indeed narrated how PW2 (the survivor) had at one instance, after running from home to avoid a beating from his wife, ran to the station and he was subsequently informed that PW2 accused him of molesting her.<\/p>\n<p>\u201cThe court finds that the totality of the testimony of the defendant who testified in his defence calling no additional witness is in essence a denial of the allegation without more.<\/p>\n<p>\u201cHe offered no reliable explanations to the charge aside from attempts to depict PW2 as a stubborn girl and one who stole from himself and his wife,\u201d she added<\/p>\n","protected":false},"excerpt":{"rendered":"<p>He was convicted and sentenced by Justice Oyindamola Ogala of the Lagos High Court, Ikeja, on Tuesday.
