{"id":314581,"date":"2024-03-14T13:51:30","date_gmt":"2024-03-14T12:51:30","guid":{"rendered":"https:\/\/www.withinnigeria.com\/news\/?p=314581"},"modified":"2024-03-14T13:51:30","modified_gmt":"2024-03-14T12:51:30","slug":"kogi-guber-supreme-court-vacates-order-stopping-sdps-ajaka-from-inspecting-election-materials","status":"publish","type":"post","link":"https:\/\/www.withinnigeria.com\/news\/2024\/03\/14\/kogi-guber-supreme-court-vacates-order-stopping-sdps-ajaka-from-inspecting-election-materials\/","title":{"rendered":"Kogi Guber: Supreme Court vacates order stopping SDP\u2019s Ajaka from inspecting election materials"},"content":{"rendered":"<ul>\n<li><strong>But the the apex court on Thursday annulled the decision of the Court of Appeal and upheld the decision of the trial court<\/strong><\/li>\n<\/ul>\n<hr \/>\n<p>The <a href=\"https:\/\/www.withinnigeria.com\/news\/2024\/02\/26\/cjn-swears-in-11-new-supreme-court-justices\/\">Supreme Court<\/a> has ruled that the governorship candidate of the Social Democratic Party, SDP, in the November 2023 election in Kogi has the right to examine election materials.<\/p>\n<p>The apex court ruling affirmed the position of the Governorship Election Petition Tribunal sitting in Abuja on the matter which had initially granted Ajaka the permission to inspect material used for the highly controversial gubernatorial poll.<\/p>\n<p>Recall that the apex court had stayed the execution of the orders of the Court of Appeal in Abuja, setting aside the inspection order of the tribunal.<\/p>\n<p>The Tribunal in November last year granted an ex parte order, allowing the SDP and its governorship candidate in Kogi for the 2023 election, Murtala Ajaka to carry out a forensic examination of all the Bimodal Voters Accreditation system, BVAS, used in the election, among other reliefs.<\/p>\n<p>However, a three-man panel of justices of the Court of Appeal, led by Justice J.O.K. Oyewole, in its ruling, on March 1, 2024, set aside the inspection order.<\/p>\n<p>But the the apex court on Thursday annulled the decision of the Court of Appeal and upheld the decision of the trial court.<\/p>\n<p>In a unanimous decision read by Justice Emmanuel Akomoye Agim, the Supreme Court held that the order of the trial court was within the scope of section 146 of the Electoral Act.<\/p>\n<p>\u201cOur position is that the motion seeking to set aside the Court of Appeal was wrong to have reversed the decision of the trial court that the motion seeking to set aside the decision of the trial Tribunal was incompetent.<\/p>\n<p>\u201cWe do not agree with the Court of Appeal. The motion was filed out of time. Secondly, the order of the trial court was within the scope of section 146 of the Electoral Act.
